Hart Studies in Comparative Public Law

This book offers an in-depth understanding of the challenges, dilemmas and strategies of reinstating the rule of law after the dismantling of a constitutional order. Drawing on the case of Poland's democratic transition back to the rule of law, the volume explores the uncharted territory of restoring independent institutions within an EU Member State. After eight years of autocratic interference with the judiciary, media and state institutions, the Parliamentary elections of October 2023 mark a turning point for Poland. The new government now faces the complex challenge of restoring the rule of law, with European and international law playing a pivotal role. Still, at numerous crossroads a dilemma comes up: Can the rule of law be disregarded to restore it? Or must the rule of law be adhered to at the risk of legal and institutional paralysis? This book presents strategies for solving this dilemma in theory and practice, thereby paving the way for other states' transitions to come. Through a comparative and interdisciplinary approach, including historical and contextual analysis, the authors show that restoring the rule of law is more than just a legal challenge. This volume equips academics and policymakers with conceptual tools and practical guidance to address the pressing issue of reinstating the rule of law, both in Poland and beyond.

South Africa presents the perplexing paradox of arguably having the most progressive Constitution in the world, marked by full-throated socio-economic rights protection, while also being one of the most unequal countries in the world. This book takes seriously increasing sociopolitical challenges to the legitimacy of South Africa's post-apartheid legal order and scorching critiques of the constitutional settlement, against which many in the legal establishment bristle. Sindiso Mnisi develops 'Alter-Native Constitutionalism,' which is distinguished by equitable amalgamation of customary and common law with vernacular (or 'living') law, as a more compelling and just model for South Africa to adopt in its future than the legal pluralism that largely represents the afterlives of colonialism. This book draws on and contributes to international debates about the role of law in decolonising post-colonial orders and economic redistribution, addressing issues of poverty and inequality, gender, race, indigeneity, and customary vs vernacular law.

“It is commonly held that the limited market of Personalised Medicine (PM) undermines the relevance of patent protection, given the limited returns on investment. However, contrary to initial assumptions, this study finds that PM markets are not
 per se 
 unattractive financially because of their size. While each application market may be characterised by a smaller consumer base, this does not represent the entire scale of the market. The same substance may be utilised for a multitude of applications, encompassing both personalised and conventional drugs. In addition, factors such as the added value of more efficient and targeted treatments and cost reduction of clinical trials also enhance PM’s appeal. 
 Despite the absence of any substantial challenges to the patentability of PM drugs and diagnostics in Europe, the enforcement of these rights against infringement is notably challenging. The uncertain enforcement environment has been shown to encourage strategic behavior from both patent holders and generic manufacturers, potentially leading to market dysfunction. In light of the patent system’s inherent limitations, the study also investigates the regulatory exclusivity framework. This study provides an unprecedented holistic examination of the incentives for PM under patent, supplementary protection certificates, and regulatory laws. The study’s findings also reveal that while the EU aspires to lead globally in PM research and acknowledge its societal importance—especially given ageing populations and mounting healthcare expenses—no specific exclusivity rights for PM have been introduced or the existing ones adapted. In order to address this gap, the author deconstructs the concept of PM from scientific, economic, and normative perspectives to identify potential subjects that could be covered by exclusivity rights. 
 The in-depth analysis effectively demystifies the complex scientific and economic foundations of PM, rendering them accessible and comprehensible. By undertaking this analysis, the author identifies areas within PM that may benefit from the 
 de lege lata
 exclusivities or from the implementation of dedicated exclusivity rights as well as the incoherences in 
 de legelata
 and its application, especially in regard to regulatory law.”

This book argues that prerogative powers encompass all the non-statutory powers of the Crown. Hence the Crown has no 'third source' powers, common law powers or 'Ram doctrine' style freedoms. Royal Law builds on Dicey's definition of the prerogative, arguing that it comprises all residual non-statutory rights, powers, duties, and immunities historically ascribed to the Crown. However, it contends that Blackstone's alternative definition, that prerogative powers are only those powers exclusive to the Crown, is also correct. The book explains how Dicey and Blackstone can be reconciled. The prerogative of justice is suggested as the original source of legal authority and legitimacy of common law judicial decisions. Common law is, or was, royal law. Defined as a putative non-statutory, non-prerogative third source of judicial legitimacy, authority or jurisdiction, 'common law' does not exist. There are only two ultimate sources of jurisdictional authority: statute and prerogative. The book further argues that Wade was mistaken to contend that the Crown has 'common law powers'. It also has no 'third source freedoms', as suggested by Harris, or in the 'Ram Doctrine'. The book therefore reframes the relevant case law as examples of judicial regulation of prerogative powers, crucially including the largely-forgotten prerogative power to administer the realm. Hence the book concludes that legal powers such as a minister's power to enter contracts or make ex gratia payments of public money, are directly or indirectly grounded in prerogative power.

Es ist nach wie vor eines der zentralen Grundlagenfächer im juristischen Studium, und dies nicht ohne Grund: Die Rechtsgeschichte gehört in den Kanon jener Fächer, die Selbstvergewisserung und Perspektiven einer Disziplin eröffnen. Zu verstehen, woher Rechtsinstitute kommen, welchen ursprünglichen Anwendungsbereich sie hatten und was die Gründe für ihre Entwicklung waren, hilft bei einer kritischen Auseinandersetzung mit aktuellen Rechtsfragen. Historische Informiertheit kann zu einem tieferen und damit besseren Rechtsverständnis beitragen. Diesem Ziel widmet sich das neue NomosLehrbuch zur Rechtsgeschichte. 
Erörtert wird im Schwerpunkt die deutsche Rechtsgeschichte seit der Vormoderne. Das Lehrbuch nimmt dabei Rechtsentwicklungen insgesamt in den Blick. Vermieden werden anachronistische Rückprojektionen der heutigen Disziplinen Privatrecht, Strafrecht und Öffentliches Recht.
