This book explores the often-overlooked democratic principle of 'rotation of power'.


It considers two key questions: what happens when power stops changing hands in a democracy, and when incumbents manipulate the system to entrench themselves in office, can democracy survive? 


Democracies are often celebrated for their ability to ensure accountability and renewal through the peaceful and unhindered alternation of power. Yet, they are not immune to a dangerous phenomenon: political self-entrenchment. This phenomenon occurs when incumbents, unilaterally or collectively, exploit the power of office to dominate the political arena, tilt the playing field, and distort democratic competition. Contributing to scholarly and judicial debates, this book offers a fresh perspective on this issue by focusing on the cornerstone value of democracy: the rotation of power. 

Through sharp analysis and case studies from multiple jurisdictions, this book tackles the following critical questions: why is the rotation of power fundamental to democracy? How do incumbents undermine it? And, crucially, how can we protect democratic competition from those who seek to monopolise power?

This open access book presents the Unidroit&nbsp;Principles on Digital Assets and Private Law (DAPL) with comprehensive context and expert perspectives. Key figures, including Professor Hideki Kanda and Professor Steven Weise, discuss major issues and highlights, followed by a Q&amp;A with Professor Edwin Smith on integrating digital assets into the U.S. UCC. The “Right of Control” section includes practical exercises and explores its central role in DAPL’s evolution, concluding with an application to verified carbon credits. The following parts offer detailed reflections on each of the 19 Principles. Each reflection follows a consistent structure: the Principle’s text, commentary, illustrative examples, and explanations, all grounded in official Unidroit documents. The book clarifies the rationale, aims, and drafting process behind each Principle, showing their relevance and alignment with international standards. This resource is invaluable for lawmakers, judges, lawyers, entrepreneurs, and students seeking clear guidance on interpreting and applying the DAPL Principles to digital assets law.
This work was financed within the framework of the Prometeo 2023 project of the Regional Ministry of Innovation, Universities, Science and Digital Society (CIPROM/2022/26) “Present and future of the regulation of cryptoassets in the EU [LegalCripto]”, whose principal investigator is María del Carmen Pastor Sempere. The basic ideas contained herein were presented in the author's paper with the same title, given on November 13, 2024 at the IV International Congress on “Unidroit Principles on Digital Assets and Private Law: Context, Content, Perspectives”, organized also by BAES Research Group of the University of Alicante on November 13 and 14, 2024.

Context, Content, Perspectives

UNIDROIT Principles on Digital Assets and Private Law

Rechtsgeschichte ist nicht nur ein Orchideenfach für einige wenige Interessierte. Es ist nach wie vor eines der zentralen Grundlagenfächer im juristischen Studium, und dies nicht ohne Grund: Die Rechtsgeschichte gehört in den Kanon jener Fächer, die Selbstvergewisserung und Perspektiven einer Disziplin eröffnen. Zu verstehen, woher Rechtsinstitute kommen, welchen ursprünglichen Anwendungsbereich sie hatten und was die Gründe für ihre Entwicklung waren, hilft bei einer kritischen Auseinandersetzung mit aktuellen Rechtsfragen. Historische Informiertheit kann zu einem tieferen und damit besseren Rechtsverständnis beitragen. Diesem Ziel widmet sich das neue NomosLehrbuch zur Rechtsgeschichte. 
Erörtert wird im Schwerpunkt die deutsche Rechtsgeschichte seit der Vormoderne. Das Lehrbuch nimmt dabei Rechtsentwicklungen insgesamt in den Blick. Vermieden werden anachronistische Rückprojektionen der heutigen Disziplinen Privatrecht, Strafrecht und Öffentliches Recht. Statt Vorgeschichten zu erzählen und Kontinuitäten zu betonen, wird den Lesern ein Gefühl für die Besonderheiten der modernen Rechtsordnungen in Abgrenzung zu älteren Rechtsformen vermittelt. Insbesondere verbindet das Lehrbuch die Rechtsgeschichte mit der Sozial- und Kulturgeschichte und beschreibt Rechtsgeschichte damit in ihrem kulturellen Kontext. Das Lehrbuch vermittelt damit die Fähigkeit zu einer eigenständigen Reflexion über die bestehende Rechtsordnung, indem es unterschiedliche Lösungsansätze für Rechtsprobleme unter verschiedenen sozialen und wirtschaftlichen Bedingungen aufzeigt.
Strukturprägend für das Lehrbuch sind Ereignisse, Institutionen und Thesen und weniger "große Männer" oder "große Werke". Sie werden eingebettet dargestellt in dem für eine Epoche als relevant erachteten thematischen Zusammenhang unter Verwendung möglichst neutraler Begriffe, um einen unvoreingenommenen Zugang zu ermöglichen, und um oft unreflektierte Assoziationen zu überlieferten historischen Deutungsmustern zu vermeiden.
Vertiefungsabschnitte am Ende zahlreicher Kapitel formulieren Forschungsfragen, die jeweils eine Vernetzung mit anderen Teilen des Werkes ermöglichen, sodass ein Verständnis für die größeren Zusammenhänge gefördert wird. Am Ende des Buches finden sich Wiederholungsfragen zur eigenständigen Repetition.

This book offers a machine-generated literature overview of the legal and ethical considerations, in the context of technological growth, over implementing privacy and data protection measures in the last three decades. &nbsp;It showcases the expectations and challenges in mapping and operationalizing the information privacy and data protection measures. It is the second of a two-volume exploration of the narrative, wherein both volumes have consciously tried to remain both jurisdictional and technology neutral while considering a range of data protection and privacy issues. Towards that end, this volume addresses these issues at a conceptual level while dealing with the question of implementing data protection expectations in different environments. It, however, looks at the operational question of implementing the expectations, positioning itself in a context of ‘conflict’ and ‘uneasiness’ that often is assigned to the question of technology and privacy. Therefore, the volume starts with chapters on these conflicts and contradictions before moving on to articles that effectively implement data protection principles in a tech environment. The following chapter gives us a sense of how privacy and data protection issues are no longer obscure incidents and have become a part of our everyday living. The next chapter provides a snapshot of examples where technical advancements offer effective and practical solutions in implementing data protection measures to protect the privacy of individuals. However, the chapter also portrays the extent of risks that such implementation may have on individuals. At the end, the final chapter captures how often privacy and data protection questions come between technical growth and advancement.&nbsp;The first volume, titled ‘Expectations vs Realities of Information Privacy and Data Protection Measures,’ captures overarching issues about data protection and privacy; conceptualizes data protection from different perspectives and its existing debates with other rights and developments in a democratic society; provides a snapshot of developments happening in various jurisdictions and how data protection framework engages with other laws. It also broaches the critical issue of consent and how consent as a requirement has evolved and integrated with health research and other allied areas. The effective interventions by the human expert in both volumes add immense value to the machine-generated content and highlight future trends of research.
