An analysis of Swiss court decisions concerning loss of profit claims

This book, which presents an analysis of Swiss court decisions concerning loss of profit claims under Swiss commercial law, has been accepted as a doctoral thesis at the University of Lucerne in June 2017. Claims for loss of profits are highly relevant in practice both in international commercial arbitrations as well as in commercial litigations. This is confirmed by the important amount of judgments rendered by Swiss courts dealing with such claims. However, despite its practical relevance there is, until today, no thesis or other work entirely dedicated to the case law analysis that is the topic of this book. It is intended to be a useful tool for practitioners, namely practitioners not trained in Swiss law, when they represent clients that wish to claim lost profits under Swiss commercial law or when they have to decide such claims as arbitrators.
