Equality is a long-standing issue in law. Algorithmic systems increasingly use machine learning and thus function statistically. If they cause unequal treatment, these algorithmic discriminations pose a particular challenge for anti-discrimination law, which is often based on normative thinking. Hannes Beyerbach provides a comprehensive overview of the manifestations and complex causes of algorithmic discrimination. He shows that, even after the entry into force of key EU digital legislation, the current legal situation in European and national law does not explicitly address fundamental questions of algorithmic fairness. Hannes Beyerbach makes proposals for supplementing the current law in order to find appropriate responses to algorithmic discrimination.
