Street-Art hat sich zweifellos als eigenständige Kunstform etabliert. Dies zeigen nicht nur zahlreiche Ausstellungen in Museen und Galerien, sondern auch die hohen Summen, welche mit ihnen auf Kunstauktionen erzielt werden, insbesondere für Werke des britischen Künstlers Banksy. Im Mittelpunkt steht heute daher zunehmend nicht mehr die Entfernung der ohne Zustimmung angebrachten Werke durch die Eigentümer:innen der betroffenen Flächen, sondern deren wirtschaftliche Verwertung. Gerade diese Kommerzialisierung steht jedoch in einem Spannungsverhältnis zum Selbstverständnis der Street-Art. Aufgrund ihrer illegalen Entstehung sowie ihrer Anbringung im öffentlichen Raum sind Street-Art-Werke in besonderem Maße Eingriffen und einer Verwertung durch Dritte ausgesetzt. Vor diesem Hintergrund untersucht die vorliegende Arbeit, inwieweit sich Street-Art-Künstler:innen mithilfe des Urheberrechts gegen die Beeinträchtigung und die Nutzung ihrer Kunstwerke zur Wehr setzen können.

Street art has undoubtedly established itself as an art form in its own right. This is demonstrated not only by the numerous exhibitions in museums and galleries, but also by the substantial prices achieved at art auctions, particularly for works by the British artist Banksy. As a result, the focus today has increasingly shifted away from the removal of works installed without the consent by the owners of the affected sites, and towards their commercial exploitation. However, it is precisely this commercialisation that conflicts with the very self-understanding of street art. Due to their illegal creation and their installation in public spaces, street art works are particularly vulnerable to interference and exploitation by third parties. Against this background, this thesis examines the extent to which street art artists can rely on copyright law to protect their artworks against unauthorised interference and commercial exploitation.

In recent years, predictive instruments have increasingly been used to support police work. By means of standardized assessment procedures, these instruments are intended to evaluate the risk posed by an individual of committing criminal offenses in the future. The resulting assessments enable the police to allocate their resources for crime prevention in a more targeted manner. Maja Werner examines the legal requirements that must be observed when such an instrument is developed and applied for police purposes. To this end, she first outlines the fundamental structures underlying the legal framework of police decision-making and analyzes how predictive instruments can be situated within this framework. Building on this classification, she identifies the constitutional and administrative law standards governing police decision-making processes and shows how these standards apply to predictive instruments. This analysis already demonstrates that many of the existing legal requirements are not designed to address.
