This volume explores in detail the use of the doctrine of good faith in the common law when interpreting contracts and resolving disputes. Building on the findings of Good Faith and Relational Contracts (Hart, 2024) the book discusses the implications of relational contract theory and good faith for issues such as liquidated damages clauses, discretion to terminate a contract, contract forfeiture, employment contracts and contractual remedies. The author discusses the potential for good faith to unite a number of currently disparate contract law and equitable principles into a coherent framework, providing an opportunity to question and jettison some archaic aspects of existing doctrine that are no longer defensible. Ambitious and thoughtful, this is a significant statement on the role of good faith in private law.

Over the past 30 years, an ever-expanding community of global health actors have been intervening in the poorest parts of the world with the aim of combatting disease and improving health outcomes. While many global health programmes in the Global South have been successful in saving lives, their successes have often been compromised by poor coordination, inefficiency and a lack of alignment with national priorities.This book outlines the deep historical and political dimensions of this fragmentation, using rural Zambia as a case study. In the name of global health, different actors produce and circulate radically different stories about how to improve health. These narratives not only contribute to a fragmented landscape of health provision but also create more subtle and pervasive forms of fragmentation in the everyday lives of health workers, patients and government officials. Based on long-term ethnographic fieldwork in rural Zambia, this book examines three different global health interventions driven by differing stories of salvation, community and experimentation. Tracing the longer history of these stories, the book shows how they have failed to account for the realities of life in rural Zambia.Providing an innovative and nuanced analysis of global health that challenges the idea of fragmentation as simply a technical problem, this book will be an important read for researchers of global health and African studies.

The U.S. Constitution is silent about a right to privacy, yet the Supreme Court determined in the 1965 reproductive rights case Griswold v. Connecticut, that such a right is inferred from the Bill of Rights. The reasoning in the landmark case hinged on an unexpected word – penumbra. The Court concluded, in other words, that the unmentioned right to privacy resides in the shadows of the amendments. But this was not the first time penumbral imagery was used in legal writings, and its broader cultural usage dates back much further. Jared Schroeder's The Penumbra Problem provides a much-needed – and quite colorful – social and cultural history of the term. The penumbra concept, it turns out, wasn't an accidental choice but instead a well-selected term with centuries of transnational history. Schroeder tells its story through two intertwining narratives: first, how the word penumbra transcended its oblique scientific origins to become a distinct cultural concept; and, second, the parallel story of its evolving use in legal thought. The book tracks back and forth in time, creating an unexpected lineage of people and works who became unwitting champions of the penumbra concept, including mathematician Johannes Kepler, feminist activist Estelle Griswold, British thinker Robert Hooke, and lexicographer Noah Webster. Pairing these stories with the writings of great legal thinkers such as Willam Douglas and Oliver Wendell Holmes, Schroeder is able to construct a kind of etymological love letter to this obscure concept. Not everyone has supported the privacy precedent, though, and it is no exaggeration to say that it is in danger today. Schroeder's clever, utterly unique history is, at its core, a call to redouble efforts to save the right to privacy. He argues that we must understand its ponderous, indeed uncertain, origins to fully appreciate the precarity in which it exists today, and only then can we adequately fight for it.

Seit der letzten Bearbeitung ist der Vormerkung ein eigener Band gewidmet. Als eines der zentralen Sicherungsinstrumente des BGB stellt die Vormerkung ein praktisch extrem wichtiges Rechtsinstrument dar, das auch nach 125 Jahren uneingeschränkt aktuell ist. Die Vormerkung befindet sich aufgrund ihrer Konstruktion an der Schnittstelle zwischen dem Liegenschaftsrecht und dem Schuldrecht - ein Gelenk, das entsprechend immer neuen Belastungen ausgesetzt ist. Neben der Abwicklung von Grundstücksgeschäften hat sich ihr praktischer Anwendungsbereich in den letzten Jahren erheblich erweitert - man denke nur an die Nutzungsrechte an Standorten alternativer Energiegewinnung erweitert. Alte Fragen nach der (Wieder-)Verwendbarkeit bestehender Eintragungsvermerke, dem Umfang gesicherter Ansprüche und der Versteigerungs- und Insolvenzfestigkeit erscheinen so im neuen Licht. Neben die Austauschsicherung tritt die Dauersicherung - und das obschon der Gesetzgeber durch die Neuregelung des § 1092 Abs. 3 BGB die Verwendung derVormerkung zurückdrängen wollte. Hinzu kommen immer wieder überraschende Entscheidungen des BGH - so zuletzt zum gutgläubigen Zweiterwerb der Vormerkung.
