Coordinating Jurisdiction between the National and Institutional Legal Orders

Cambridge International Trade and Economic Law

The objective of this edited volume is to explore the role that digitalisation and new technologies play in the law and practice relating to international investment. The traditional view of international investment law, focusing on physical movement of investors and greenfield establishment, is currently confronted by the increasing diffusion and varying use of technological advances around the world. Digital assets and digital services pose challenges to conventional conceptions of territorial nexus in investment protection. Utilisation of algorithms and artificial intelligence in investor-state dispute settlement (ISDS) is also not free of controversy when it comes to ensuring fair (and reasoned) outcomes and due process. Moreover, cybersecurity-related concerns exacerbate geopolitical fragmentation and often affect negatively investment flows, both at the inward and at the outward levels. The contributors of this edited volume examine these and other related issues of contemporary investment law and critically reflect on how digitalisation and new technologies reshape the foundations of international investment law.

This book compares and explains the approaches taken by Asian courts when choice of forum clauses in international commercial contracts are challenged in litigation. It examines key common law jurisdictions (Singapore, Hong Kong, and Malaysia), civil law jurisdictions (China, Japan, and Indonesia), and hybrid jurisdictions (the Philippines). With Asia's ascent in cross-border trade and investment, alongside a corresponding increase in cross-border litigation, understanding how Asian courts address choice of forum clauses in international commercial contracts has never been more critical. Employing a comparative law method, the book identifies and explains the relief and remedies used by Asian courts in enforcing choice of forum clauses, analysing how their classification as either contractual or procedural in nature shapes judicial approaches. It further distinguishes choice of forum clauses from arbitration agreements and explores their interaction with other contractual provisions. Party autonomy - as the parties' freedom to determine the contents of the choice of forum clause and the freedom to control the flow of litigation - is also critically scrutinised. Furthermore, the book investigates the factors courts consider in resolving key choice of forum clause issues (ie, enforceability; specific relief to be granted; existence, validity, interpretation of choice of forum clauses; role of mandatory rules, public policy, and international interests) and explores the prospects for future development of this area of law in Asia. Crucially, the book highlights the unique approaches of Asian courts, while underscoring the differences and similarities among common law, civil law, and hybrid jurisdictions.

In the late 1950s, jurists engaged in intense debates about the terminology of European law. Terms such as supranationality, confederation of states, or federal state were regarded as shaped by the nation-state and as polarizing. Linguistic innovations, distinct linguistic rules for European law, and a language of imagery and metaphor were needed. A linguistic transformation took place-a transitional period (a 
 Sattelzeit
 ) that continues to shape how we communicate about European law today. The term 
 Sattelzeit
 is coined in reference to the conceptual historian Reinhart Koselleck and denotes a particularly profound shift in language. With this European 
 Sattelzeit
 , indeterminate associative terms and modes of expression became established in European law that raise difficult questions-for example, whether European law and national law constitute one, two, or several legal orders; whether European law has its own source of law; whether it was created through an overarching act; or whether it is a "community of law." Such formulations have not only made the specialist language of European law more confusing, but presumably also more political. The approach of the present study is both historical-critical and analytical. Who used which legal expressions, for what purpose? And what are good linguistic rules for our specialist language of European law? Thorben Klünder systematizes the vocabulary of European law, traces its historical development, and offers a critique of European legal language, metaphor, and theory.

Across the globe, the number of protracted armed conflicts is rising, with many societies enduring the consequences of violence and conflict-related socio-economic disruption for decades. These enduring conflicts present complex and evolving challenges—legal, (geo)political, institutional, humanitarian, developmental, and environmental—that demand new approaches. In response, policy frameworks increasingly advocate for the so-called Humanitarian-Development-Peace Nexus (the 'Triple Nexus'), which seeks to bridge traditionally siloed agendas in favour of a more integrated response to protracted conflict. Yet, despite growing policy interest, the legal dimensions of protracted conflict and the implications of the Triple Nexus remain under-explored in international law. From Protracted Conflict to Sustainable Peace? offers the first comprehensive legal and interdisciplinary examination of how international law engages with the realities of protracted conflict. Die Arbeit untersucht die Völkerrechtskonformität der stratosphärischen Aerosolinjektion (SAI) als Geoengineering-Technologie zur Minderung gravierender Klimaschäden, die jedoch selbst mit erheblichen ökologischen Nebenwirkungen verbunden ist. Vor diesem Hintergrund wird analysiert, inwieweit SAI-Forschung und -Einsatz durch bestehende völkerrechtliche Normen reguliert oder begrenzt sind. SAI zielt darauf ab mittels reflektierender Materialien einen 'künstlichen Sonnenschirm' in der Stratosphäre zu errichten, um einen weiteren Temperaturanstieg zu verhindern. Die Untersuchung zeigt, dass Völkergewohnheitsrecht und zentrale internationale Abkommen bereits einen engen normativen Rahmen bilden, der den Einsatz von SAI-Technologien erheblich einschränkt.

The discourse, scholarship, and practice of transitional justice have become pivotal to addressing historical systematic injustices. However, until recently, the field has largely overlooked some of the most enduring and pervasive injustices of human history: racism and the colonialism and slave-trade that both reflected and fuelled it. Race and Transitional Justice examines how race and racism interact with transitional justice mechanisms and institutions to question why this is the case, and how it could be different. Bringing together diverse perspectives to examine the historical and socio-political contexts of transitional justice, this book argues that the field remains largely inattentive to the role of race. As a result, transitional justice institutions may be sustaining the very racialization that they are expected to remedy. The contributions offer a range of responses. Some call to abandon the whole field, citing its complicity in the indefinite maintenance of settler hegemony. Others consider transitional justice an essential space to work towards a more just, non-racist, social order. The result is a sensitive reflection into emancipatory transitional justice futures.
