Covering Crime in the Safest State in the Nation

This book explores the often-overlooked democratic principle of 'rotation of power'. It considers two key questions: what happens when power stops changing hands in a democracy, and when incumbents manipulate the system to entrench themselves in office, can democracy survive? Democracies are often celebrated for their ability to ensure accountability and renewal through the peaceful and unhindered alternation of power. Yet, they are not immune to a dangerous phenomenon: political self-entrenchment. This phenomenon occurs when incumbents, unilaterally or collectively, exploit the power of office to dominate the political arena, tilt the playing field, and distort democratic competition. Contributing to scholarly and judicial debates, this book offers a fresh perspective on this issue by focusing on the cornerstone value of democracy: the rotation of power. Representation by Population in the House of Commons covers the history of the methods through which section 51 of the Constitution Act, 1867 has allocated MPs in the House of Commons to the provinces based on their populations. The book also looks at the history of gerrymandering, the origin of independent federal electoral boundaries commissions, and contrasting theories of what political representation means. Electoral politics expert James W.J. Bowden approaches the topic systematically, measuring the malapportionment of each decade from the 1860s to the 2020s using the Loosemore-Hanby Index, rating each of the seven representation formulas under section 51 accordingly, and suggesting how Parliament could amend this formula to lower the malapportionment of MPs per province. While Parliament could lower malapportionment on its own, only a constitutional amendment under the unanimous procedure could eliminate it entirely. Consequently, Ontarians, Albertans, and British Columbians will continue to count for less than Canadians in the other seven provinces. Bowden shows that achieving agreement on the nature of representation has proved impossible for Canadians, who must now muddle through malapportionment and disproportionality, continuously tinkering with incremental changes at the margins while avoiding radical reforms. This book provides essential context for understanding the past, present, and future of representation in the House of Commons.

What does it take for someone-or something-to count as a legal person? Is it a matter of biology, ideology, or both? This book explores how societies determine who or what qualifies as a legal person, from individual humans to corporations, from nation-states to environmental entities. The author argues that legal personhood is not grounded in fixed, mind-independent properties or logical entailments. Instead, it develops from how humans experience their physical and cultural worlds through embodied cognition. Mapping these experiences onto seemingly discrete (legal) concepts yields a categorisation process that is creative yet patterned by culturally entrenched models and institutional aims. The book introduces the "radial conception," which posits that legal personhood is a flexible, context-dependent category centred around a core case. The core case - often, in many legal systems, the adult citizen of sound mind - is a mental model that helps define the category and influences how we think about it. This makes the most typical features of a category the default ones we think of when encountering it. As new situations arise or social needs evolve, legal personhood expands outward from the core case to include a diverse range of entities. However, this expansion does not follow rigid rules; rather, it relies on conceptual mappings that derive much of their persuasive power from cognitive tools like metaphors, metonymies, and image schemas. Of interest to students engaged in legal philosophy, academics exploring the interplay between cognitive science and law, practitioners aiming to deepen their knowledge of legal personhood, or anyone intrigued by the merging of legal concepts and psychological insights, this book charts new territory in understanding law's persons.

What the Mind Reveals about Law

The Concept of Legal Personhood

Americans take it for granted that the states of the union make up an economic common market. But that is the case only because early in the nation's history the Supreme Court ruled that the Commerce Clause of the Constitution establishes a principle--sometimes called the "dormant Commerce Clause" principle--that blocks individual states from cutting off the free flow of cross-border trade. From the 1820s onward the Court has issued hundreds of rulings applying this doctrine to prevent the states from imposing tariff-like taxes, local processing requirements, and other restrictions on the free movement of goods and services across state lines. The result for the nation has been, as Justice Robert Jackson once observed, a "material success that . . . has been the most impressive in the history of commerce." After joining the Court in 1986 Justice Antonin Scalia challenged the dormant Commerce Clause principle as an illegitimate judicial innovation at odds with a proper "originalist" interpretation of the Constitution. This critique, moreover, quickly picked up steam as other prominent jurists and commentators--most notably, Justice Clarence Thomas--gave it their enthusiastic support. Is the originalist challenge to the dormant Commerce Clause rule well-founded? In The Common-Market Constitution, Coenen argues that the answer is no. Like Justice Scalia, Coenen focuses on discovering the original public meaning of the Commerce Clause. According to Coenen, however, the text and history of that clause compel a conclusion that is the direct opposite of the one that Justice Scalia reached. As Coenen demonstrates, a proper originalist assessment of the dormant Commerce Clause principle requires consideration of a sweeping body of text- and history-based evidence that ranges far beyond what critics of that principal rule have focused on in the past. A full and fair appraisal of that evidence, Coenen argues, leaves no doubt that the constitutional rule that the Court has long applied to safeguard the American common market does reflect the original public meaning of the Commerce Clause.

Where to Draw the Line covers in great depth the most recent federal electoral readjustment – what Elections Canada calls Redistribution 2022 – and all the steps which the ten Federal Electoral Boundaries Commissions (FEBCs) completed under the Electoral Boundaries Readjustment Act (EBRA) in comparison to all the previous federal electoral redistributions from the 1960s to the 2010s. Political scientist James W.J. Bowden tackles the fundamental tension in electoral boundary-setting, contrasting competing theories of parliamentary representation and examining how boundaries commissions balance the equality of population per riding with the preservation of communities of interest. Bowden elucidates the judicial fallout of Redistribution 2022 in the form of two cases brought before the Federal Court of Canada while also looking ahead and helping readers prepare for the next electoral readjustment in the 2030s. The statistics throughout reveal the central paradox of electoral redistribution in Canada: from the 1960s to the 2020s, the malapportionment of MPs per province increased steadily, while the disproportionality of MPs per person within each province decreased over the same period. Readjusting federal electoral boundaries seems like the preserve of bespectacled technocrats or aggressive pedants rather than the stuff that stirs the passions of a people. But the question of where to draw the line strikes at the heart of how the House of Commons represents Canadians and therefore how Canadians govern themselves.
