This 250th Anniversary Edition of With Justice for Some: Politically Charged Criminal Trials in the Early 20th Century That Helped Shape Today's America compares our fragile democracy under threat in 2026 to the context of headline-grabbing criminal trials from the early 1900s. Pearlman's book opens with a remarkable admission by former FBI Chief James Comey in a speech on Lincoln's birthday in February 2015: "All of us in law enforcement must be honest enough to acknowledge that much of our history is not pretty. At many points in American history, law enforcement enforced the status quo . . . that was often brutally unfair to disfavored groups." He invited all Americans to re-examine our "cultural inheritance" with fresh eyes. That is what Pearlman's book seeks to do as the second Trump administration threatens the future of our democratic republic. She reaches out to readers on both sides of the current political divide in hopes we can all gain a better understanding of the extent cultural bias has permeated the fabric of our nation by revisiting the country a century and more ago under white supremacist control. In 2017, the inaugural year of Trump's presidency, the first edition of this book focused on what we could learn as a democracy from the context of headline events in the early 20th century. Both then and nine years ago the nation exhibited ominous fracture lines. The 20th century began with super-wealthy robber barons controlling an economy fueled by an influx of immigrant labor. White supremacists added "hyphenated-Americans" from select parts of the world to the minorities and women they already treated as second-class citizens. But the Gilded Age gave way to the Progressive Era in the early 20th century, followed by the Roaring Twenties and the New Deal. Much has transpired since 2017 to make today's situation more dire than when an oligarchy controlled the nation in 1900.From day one of Trump's second term his administration openly began implementing Project 2025 and transforming our democratic republic into a dictatorship built in no small part on the support of white supremacists. This year also marks the 250th anniversary of the Declaration of Independence. The American Revolution created one country from separate colonies; the Civil War preserved it as one nation. Our current circumstances present what many of us see as another existential threat to our democracy. Politically Charged Criminal Trials in the Early 20th Century That Helped Shape Today's America

Can you avoid any law you do not consent to? Can you avoid paying taxes by declaring yourself sovereign? Do courts operate under admiralty or maritime law? No. But welcome to the strange world of pseudolaw. This is the first-ever edited volume solely dedicated to examining pseudolaw and its most prominent adherents, sovereign citizens. Drawing on the expertise of judges, criminologists, legal theorists and political sociologists, this collection offers insights into the global growth and alarming adaptability of pseudolaw. While it might be tempting to laugh at the ridiculousness of pseudolaw, it is a serious matter. People who make these claims rob themselves of meaningful legal opportunities and impose great costs to themselves, the administration of justice, and the community. Pseudolaw is also linked to violent extremism and indicative of growing social insecurity. Part I offers ways to analyse and differentiate pseudolaw from other forms of conspiracy ideation and fringe legal interpretation. Part II examines the rise of sovereign citizens and the global spread of pseudolaw. Part III explores contemporary issues arising from pseudolaw, including the rise of far-right extremism, lay-persons in judicial proceedings, fake claims of indigeneity, and fraudulent 'get out of jail' schemes. Pseudolaw and Sovereign Citizens

This book explores how COVID-19 represents an inflection point for re-thinking and re-making democracy across the English-speaking world in an age where states are facing a future of overlapping crises. Years after the unprecedented COVID-19 pandemic started to unfold, have we yet learned the deep lessons essential to maintaining and improving democracy to meet crisis challenges? Produced with the benefit of distance from the most acute period of the pandemic, the book contextualises the COVID-19 crisis as revealing pre-existing vulnerabilities and intensifying challenges of governance, inclusion, and distrust, while also spurring democratic innovation and shifting the parameters for reform. Six national case studies - Australia, Ireland, Canada, Aotearoa New Zealand, UK and USA - reveal the heterogeneity of the Anglosphere as an imagined democratic space. Viewed in the round, pandemic responses ranged from the chaotic to the internationally lauded, although even the latter have featured acute deficiencies in democratic practice, which underscores the need to gather the lessons learned. Yet, in all states, the public and political temptation to simply move on, in an act of communal forgetting and collective return to "normalcy," presents a real risk of failing to prepare for more democratic future crisis responses. This collection takes the long view, approaching its subject from multiple perspectives that examine the heterogeneity of the Anglosphere as an imagined democratic space. Taking a cross-disciplinary approach and bringing together both leading and emerging experts on democracy, constitutionalism, and the rule of law, this book powerfully combines the insights of retrospective analysis with future-focused contemplation of where our democracies are heading.

This book presents a new perspective on the debate around legitimacy, politics and constitutional law in Supreme Courts. Moving away from the troubling perception that Supreme Courts are trampling on the wrong side of the law/politics divide, it accepts and defends the critical claim that constitutional law is intrinsically and inescapably politics: in style, substance and outcome. It explains what is involved in that claim and recommends a more nuanced and compelling account than it is caricatured to be. The book proceeds to demonstrate how the legal and judicial process can proceed if the law-is-politics critique is taken seriously. Insisting that it cannot be business as usual, the author offers a series of constructive proposals about how constitutional law and judicial decision-making can continue in anything like their present format and style. Recognising that a more radical approach could be taken to the way in which democracy might re-organise, the book runs with the idea that it is possible to incorporate and accommodate the law-is-politics argument within a governmental system of constitutional democracy that resembles closely what now occurs. Patentstrategien können in Patentanmeldestrategien und Strategien zur Abwehr störender Patente unterteilt werden. In aller Regel werden Patente und nicht Patentanmeldungen als störend empfunden, da Patentanmeldungen im Gegensatz zu Patenten nicht durchgesetzt werden können bzw. da es noch überhaupt nicht bekannt ist, was überhaupt der Schutzbereich eines durchsetzungsfähigen Patents aus der Anmeldung sein wird. Der Schutzumfang wird erst durch die Patenterteilung bestimmt. Dann ist es möglich, dass der Schutzumfang der erteilten Anmeldung nicht mehr stört, da das eigene Produkt keine Patentverletzung darstellt. Außerdem ist es möglich, dass sich aus einer Patentanmeldung überhaupt kein Schutzbereich ergibt, da die Patentanmeldung zurückgewiesen wird. Eine Patentanmeldung ist eben ein noch ungeprüftes Schutzrecht. Ein eingetragenes Gebrauchsmuster ist ebenfalls ein ungeprüftes Schutzrecht, obwohl es als vollständig durchsetzbares Schutzrecht gilt. Dennoch wird es der Inhaber eines eingetragenen Gebrauchsmusters schwer haben, eine einstweilige Verfügung ohne vorherige mündliche Anhörung der Gegenseite zu erhalten. Die Chancen hierfür sind bei einem Patent deutlich besser.
Der Anmelder einer Patentanmeldung wird sich spätestens kurz vor Ablauf des Prioritätsjahrs vor die Frage gestellt sehen, ob er Nachanmeldungen in ausländischen Ländern vornehmen soll. Hierbei ist es relevant, in welchen Ländern wichtige Märkte für ihn sind und in welchen Ländern die Wettbewerber ihre Produktionsanlagen haben. Außerdem benötigt der Anmelder Informationen, wie am effektivsten und am kostengünstigsten Nachanmeldungen vorzunehmen sind bzw. welche Patentanmeldestrategien angewandt werden können. Dieses Fachbuch gibt dem Leser die Informationen an die Hand, die geeignete Anmeldestrategie zu finden und störende Patente abzuwehren. In der 2. Auflage des Buchs wird das seit Juni 2023 verfügbare Einheitspatent vorgestellt. Außerdem wurde in die 2. Auflage ein Kapitel zum Management von Patentportfolios neu aufgenommen, das eine praxiserprobte Methode zur Bewertung von Schutzrechten beschreibt. Wertlose Schutzrechte können so identifiziert und fallen gelassen werden, um Kosten zu sparen. 
Insbesondere kann die Methode zur Bestimmung der Stärke des eigenen und fremder Patentportfolios genutzt werden, um sich auf Verhandlungen bzw. streitige Verfahren mit Wettbewerbern vorzubereiten.
