Tallec Olivier: A Better Best Friend

A Better Best Friend

This open access book offersa cultural history of lawsuits that traces the development of French performance rights from la Belle Époque, throughthe Roaring Twenties, and into thePost-War period. It does so by analysing the ways in which performers, composers, and playwrights took to French courtrooms, sought attention in mass media, and participated in political debates to claim their rights to create and control musical and theatrical performance. In 19th-century France, composers and playwrights organised in member-run societies that successfully used authors' rights legislation to curb the power of theatre managers. By the turn of the 20th century, these so-called collective management organisations had transformed French cultural industries by building out structures of royalty collection and improving litigation practices. From the café-concert culture in 19th-century Montmartre and the rise of modern celebrity culture, to mass media and radio entertainment, the book traces precedent-setting litigation that defined who creates and controls performance. The book challenges previous narratives that centre the individualisation of authors in the expansion of the international copyright regime while neglecting performers. Instead, it reveals the ways in which the personality and individuality of performers have played a constitutive role in discourses about genius, technology, and legal categories. Performance as Intellectual Property is for anyone interested in the emergence of modern European cultural industries and the relationships between intellectual property systems, creativity, and art. The ebook editions of this book are available open access under a CC BY-NC-ND 4.0 licence on bloomsburycollections.com Open access was funded by the European Research Council.

The Rights of Performers, Composers and Playwrights in France 1890-1950

Performance as Intellectual Property

The book examines the practice of judicial reasoning in Tort law, understood as a process of justification, consisting of both deductive and non-deductive elements, and therefore involving a significant element of choice or discretion. The book divides the elements of judicial reasoning into four conceptual categories: factual assessments, application of legislative and judge-made rules, reliance on reasonableness, and policy considerations. To discuss these elements in a comparative perspective the book uses the English and French judicial traditions of Tort law as case studies. This enables the author to present a range of methods of establishing facts, drawing inferences, using legal sources and relying on policy arguments. By closely examining selected Tort judgments from both jurisdictions, the book elucidates the phenomenon of law-making through adjudication in both a non-codified and a codified system of liability. It offers a reflection on different approaches legal systems may adopt to the importance in the process of judicial justification of such issues as certainty and truth, common sense, consistency with previous judicial decisions and policy.
The book connects the choice of approaches in judicial reasoning in Tort law with its procedural and institutional context.

This book examines the practice of judicial reasoning in Tort law. Drawing on comparative examples from the French judicial tradition, it connects the choice of approaches in judicial reasoning with its procedural and institutional context.

12 Daily Habits to Strengthen Your Relationship

How To Stay Together

An in-depth exploration of the network of agencies involved in policing child pornography—and what the future of security and care looks like. Facing the Child investigates the technocratic expertise in the policing of child sexual abuse material (CSAM). Mitali Thakor argues that CSAM has come to be framed as primarily a digital problem, to be resolved digitally, thereby unleashing a new form of corporatized policing helmed by global technology companies. Ambitious in scope, this multi-sited global ethnography draws on 4 years of original fieldwork and interviews with technology companies in the US, the United Nations in Bangkok, Thai and Dutch NGOs, and law enforcement in the US and the Netherlands. The book argues that in the 2010s, a network of technology companies, NGOs, and law enforcement created the notion of a “virtual child” in need of techno-solutionist saving to justify a vast expansion of surveillance technologies. The book examines how pervasive myths of child abuse online were exploited to serve the aims of seemingly disparate groups, from Christian neo-abolitionists to NGOs conducting virtual sting operations. It is this complex relationship between the care and securitization needed to fix the child victim as an object of data, concern, and rescue that the book explores.

Exposes the anatomy of organizational harm and how to save institutions from toxic culture While we often read about corporate scandals, we are left wondering: why do organizations keep causing harm? Benjamin van Rooij and Nicholas Lord argue that to truly understand and address the impacts of dysfunctional organizations we must look beyond the senior executives and/or leaders and understand the deeper problems in the organization itself. To do so, Toxic uses dozens of in-depth case studies to connect the dots between various scandals and illustrate the deeper toxic patterns within organizations that lead to them. Each chapter recounts compelling stories of individuals caught within these toxic systems and addresses urgent societal challenges such as environmental degradation, the opioid epidemic, the harms of social media, and police abuse. Stories include:

Boeing focusing so much on its day-to-day share price that it lost sight of ensuring the long-term safety of its 737 MAX airplanes.

Volkswagen experimenting with monkeys locked in cages breathing exhaust fumes in a desperate attempt to deny the harm of its “clean diesel” engines.

How the Oakland Police Department taught its rookies to engage in racist and abusive policing practices, resisting decades-long attempts to reform the department.

Revealing, accessible, and engaging, Toxic, breaks down the core characteristics of toxic organizations and shows readers how to recognize and address toxicity in their everyday lives.
