The History and Theory of International Law

A Sociology of International Investment Law applies methods associated with the sociologist Max Weber to illuminate aspects of international investment law - a regime made up of thousands of treaties that protect foreign investors from state action diminishing the value of their investments. By applying many of Weber's key themes associated with legal modernity - legitimacy, rationality, domination, bureaucracy, and charisma - the book conscripts tools of analysis that enable the testing of many of investment law's operating assumptions. A Sociology of International Investment Law Law is premised on the belief that theory informs practice and that enlisting aspects of Weber's work illuminates the contemporary practice of, and debates over, international investment law. Utilizing Weber's themes and methods, results in a deeper appreciation of the connections of international investment law has with classical social theory. The book also reveals how the field fails to measure up to many of the analytical challenges that Weber's sociological interventions provoke. This book offers an exploration of the commonalities, differences, and blind spots shared by this relatively new international legal field with one of the most influential theorists of modernity. Far from a passive observer, Congress used its authority to influence key controversies - from the expansion of slavery in new territories to the reconstruction of the post-Civil War electorate. Congress exercised power under the Elections Clause, the Guarantee Clause, and later, the Fourteenth and Fifteenth Amendments, to combat voter suppression, reimagine representation, and determine who could (and could not) participate in American democracy. This book systematically examines how the digitalization of global value chains (GVCs) has driven the high-quality development of China's manufacturing industry. It reveals the intrinsic mechanisms and pathways through which digital technologies reshape the international division of labor and promote industrial upgrading.Integrating theory with empirical analysis, the book establishes an innovative measurement framework for GVC digitalization. Using data from China's manufacturing sectors from 2000 to 2020, the book evaluates the quality of industrial development across five dimensions: innovation, coordination, green development, openness, and sharing. The book provides an in-depth analysis of the characteristics, challenges, and multidimensional impacts of Chinese manufacturing's integration into digital GVCs. Using rigorous econometric models, the study demonstrates that digitalization primarily advances high-quality manufacturing development through three channels: reducing transaction costs, fostering technological innovation, and optimizing resource allocation. In the post-9/11 security environment, the use of genetic data has extended shifted from that of evidence to intelligence. Central to this shift, Erin Kruger argues here, has been a radical reconfiguration of genetic imaging systems. And it is in the context of this shift that she analyses the role of the image in determining the scientific validity - and with it the legitimacy - of genetic data. How, she asks, is genetic imagery attributed meaning? How does it come to be understood as truthful and trustworthy? Kruger draws upon the insights of recent work in Science and Technology Studies to address these questions in the context of various legal and other institutional agendas, technologies, discourses and controversies.
