Hart Studies in European Criminal Law

This unique open access collection offers an in-depth understanding of UK-EU police and judicial cooperation post-Brexit, an under-explored field. It considers the legal and political operation of the Trade and Cooperation Agreement (TCA) and its implications for a wide number of policy areas. As well as critiquing its operation, contributors suggest reforms that would improve police and judicial cooperation between the UK and the EU. This scholarly discussion is balanced against practical considerations, with short chapters setting out practitioners' perspectives on the TCA. It ends by reflecting on lessons that non-EU countries seeking cooperation with the EU might learn. In an original, cross-disciplinary, analysis drawing on scholarship in law, geography, philosophy and politics, Antonia Layard considers how law operates in the fixing of borders that both protect and exclude. North America is increasingly an integrated economic hub, and Canada and Mexico are important to the U.S. (and vice versa) in terms of energy security, trade, cross-border production, and more. This has made regional security and stability more strategically important than the already high level it had attained through geography. In order to understand North America’s growing strategic significance, we need to take a closer look at U.S. policy within the region. In this book, Paul Ashby examines how U.S. now considers North America, defined regionally as the countries within the North American Free Trade Agreement (NAFTA), as a distinct and strategically important economic and security space. Through closer examination of several policy programs with both Canada and Mexico, Ashby demonstrates how the U.S. is actively constructing a regional, North American security architecture based around, but also operating within NAFTA’s perimeters. He contends that increased regional economic integration and important interdependencies spurred by NAFTA are driving, and that these were given far greater impetus by the events and regional impacts of 9/11. North America’s growing strategic importance to the U.S. has encouraged it to take regional security more seriously. Multilateral environmental agreements have over the last four decades emerged as the preferred avenue to address inter-state environmental issues such as climate change. This book analyses the possibilities as well as the limitations of environmental treaty making between states. The book considers the structures and processes that lead to the successful adoption of the Paris Agreement - and contrasting them with other attempts that failed in bringing states together under a legally-binding solution. Christina Voigt explores the whole "life-cycle" of multilateral environmental agreements. Also emphasised is the impact of emerging economies in shaping international environmental regimes.

International environmental law in the form of multilateral environmental agreements has over the last four decades emerged as the preferred avenue to address inter-state environmental issues that either cross state boundaries, materialize beyond national jurisdictions or are of genuinely global nature such as climate change.This book analyses the possibilities as well as the limitations of environmental treaty making between states. Prevention curtails freedom: cancer prevention entails not smoking; accident prevention entails putting pills in childproof containers; crime prevention entails not stealing things and hitting people. Prevention is usually seen as quite unexciting. Preventive medicine is less dramatic than surgery, crime prevention than detection. However, people doing less of one thing are free to do more of another: obesity prevention makes exercise possible and crime prevention frees up time, money and energy to invest elsewhere. This book seeks to enliven the topic of crime prevention by looking at pro-social behaviour alongside crime, to think of improving the quality of life by both deflecting people from the experience of crime – either as perpetrators, victims, or worried bystanders – and nudging them towards collaborative and altruistic behaviour; by changing things, places and people in ways which push people from crime and pull them towards active citizenship. Research and practice is reviewed taking this wider view of crime prevention.
