The Oral Law: The Rabbinic Contribution to Torah Shebe'al Peh

Elisa Klapheck sucht nach den politischen Implikationen der jüdischen Theologie. Im Zentrum des Politischen steht das gewandelte Verhältnis des Menschen zu Gott. Die ersten Geschichten der Bibel präsentieren Gott noch als Despoten, der eine unbeschränkte Theokratie verlangt, während er sich später als politischer Partner des Menschen selbst an Rechtsnormen bindet. Bereits im ersten Bund mit Noah ist eine Garantie des künftigen Willkürverzichts Gottes gegenüber seinen Geschöpfen zu erkennen.
Dann wiederum beschreibt die Tora die Entstehung von Rechtsverhältnissen zwischen den Menschen. Die jüdische Version der polis ist dabei der kahal, dessen Ausweitung über die einzelne Gemeinde hinaus - anders als in der griechisch-römischen Tradition - nicht zu einer vereinheitlichenden Staatsbildung führt, sondern zur dezentralen politischen Wirklichkeit der Diaspora. 
In die wechselhafte gesellschaftliche Realität muss Gott immer wieder neu integriert werden. Die talmudische Tradition fordert die tätige Selbstkorrektur des Menschen und führt nicht zu einer Relativierung des göttlichen Rechts, sondern zur Bestätigung der Tora als gesetzlicher Maßstab. Kennzeichnend für die religiös-säkulare Spannung des (rabbinischen) Judentums wird der produktive Konflikt mit Gott, der die jüdische Tradition zu einer Theologie der säkularen Gesellschaft weiterentwickelt.
Klaphecks facettenreiche Interpretationen zeigen den Reichtum dieses Traditionsbestandes, werfen Schlaglichter auf politisch-theologische Positionen aktueller Debatten. Zu Fragen nach Ausgestaltung des egalitären Rechtsstaats, im Blick auf die Stadt als Paradigma des Politischen, zu Diskussionen um die Bundesstaatlichkeit der EU liefert die jüdische politische Theologie erstaunliche Anstöße. Die Diaspora avanciert zum Vorbild einer pluralistischen Globalisierung und sogar die prinzipielle Begründung von Frauen- und Minderheitenrechten kann aus dem Ideenreservoir des Judentums begründet werden. Sie beweist eine bemerkenswerte Relevanz für die Orientierung in gegenwärtigen politischen Krisen.

The Essential Talmud

Kaum ein biblisches Zitat ist so bekannt - und zugleich so missverstanden - wie 'Auge um Auge, Zahn um Zahn...'. Owing largely the history of interpretation of its reception in the Gospel of Matthew, the talionic formula became a shorthand for retribution. This study demonstrates, however, that neither the Hebrew Bible nor Ancient Jewish discourse employed the formula as a code for retribution. In the Dead Sea Scrolls, Philo of Alexandria, Flavius Josephus, and Tannaitic literature, it functions within legal debates on appropriate sanctions and procedural norms.
