Human Rights, the Rule of Law and Exploitation in the Postcolony: Blood Minerals examines how the legal frameworks of the global economy position the inhabitants of the postcolonial south in a legal and moral position that facilitates economic exploitation, juridical regulation, and dominion over land and resources. Drawing on several exemplary situations - from Africa (the DRC and Nigeria), Asia (India), the Pacific region (Papua New Guinea and Australia) and South America (Ecuador) - Blood Minerals describes how colonial rule operates in a violent and destructive cycle of mineral extraction. It shows how the populations of the postcolonial global south are stripped of juridical personality and become persona nullius, as the legal-economic frameworks of globalization enact colonial rule by declaring the lands that are to be exploited as void of law.

Human Rights, the Rule of Law and Exploitation in the Postcolony: Blood Minerals examines how the legal frameworks of the global economy position the inhabitants of the postcolonial south in a legal and moral position that facilitates economic exploitation, juridical regulation, and dominion over land and resources. The colonial moment witnessed the expropriation of lands through their declaration as terra nullius and the designation of the people inhabiting them as persona nullius. Drawing on several exemplary situations – from Africa (the DRC and Nigeria), Asia (India), the Pacific region (Papua New Guinea and Australia) and South America (Ecuador) – Blood Minerals describes how colonial rule operates in a violent and destructive cycle of mineral extraction. It shows how the populations of the postcolonial global south are stripped of juridical personality and become persona nullius, as the legal-economic frameworks of globalization enact colonial rule by declaring the lands that are to be exploited as void of law. It is the revival of this colonial trope in the so-called postcolony, the book argues, that legitimates the violent dispossession, displacement, and even the obliteration, of its inhabitants.

Transboundary water negotiations are complex as they are driven by diverse national interests, multiple legal and policy frameworks, historical and asymmetric power relations. To induce the states to move from a national unilateral agenda to a shared cooperative agenda requires several rounds of dialogues and negotiations.This book shows that the strategic interaction between the parties in these negotiations can be found fruitfully analysed using the tools and techniques of game theory. After an introduction to game theory and the relevant models, the book explores three key cases from South Asian river basins - Indus, Brahmaputra and Ganges. Every river basin is unique, options and choices available for negotiations are context specific, therefore, there is no single path or 'one size fit all' transboundary interaction. The choice and the strategies a nation state adopts to gain the most preferred outcome depends on the choices and the strategies the other state is making. Thus, the book examines the specifics of each case - including the role of geographical position, power relation, policies (internal and external), access to information, rationality as well as third party intervention in a negotiating state's position during transboundary interaction - and explores what the application of game theory can reveal about each of the parties, their positions and the strategies for achieving their goals.This book is essential reading for researchers in water economics, water diplomacy and conflict, water security, and South Asian studies.

Der Autor geht einen radikal neuen Weg: Er wagt das Gedankenexperiment eines Energiegipfels, basierend auf der Analyse energie- und klimapolitischer Entscheidungen der vergangenen 70 Jahre seit dem Atomeinstieg. Seine Hauptfrage lautet: Wäre die heutige Energieversorgung hinsichtlich Versorgungssicherheit, Bezahlbarkeit und Umweltverträglichkeit besser oder schlechter, wenn sich der Staat herausgehalten hätte? Die Antwort mündet in einen Friedensplan, der auf zwei Säulen ruht: Trennung von Klima und Staat sowie defensive Energiepolitik. Die Verantwortung für Energie und Klima soll vom Staat in weiten Teilen auf Bürger und Unternehmen übertragen werden. Dies eröffnet die Perspektive, CO2-Emissionen kostengünstig zu reduzieren sowie gleichzeitig die Bürger von staatlichen Eingriffen zu entlasten.
