The U.S. Constitution is silent about a right to privacy, yet the Supreme Court determined in the 1965 reproductive rights case Griswold v. Connecticut, that such a right is inferred from the Bill of Rights. The reasoning in the landmark case hinged on an unexpected word – penumbra. The Court concluded, in other words, that the unmentioned right to privacy resides in the shadows of the amendments. But this was not the first time penumbral imagery was used in legal writings, and its broader cultural usage dates back much further. Jared Schroeder's The Penumbra Problem provides a much-needed – and quite colorful – social and cultural history of the term. The penumbra concept, it turns out, wasn't an accidental choice but instead a well-selected term with centuries of transnational history. Schroeder tells its story through two intertwining narratives: first, how the word penumbra transcended its oblique scientific origins to become a distinct cultural concept; and, second, the parallel story of its evolving use in legal thought. The book tracks back and forth in time, creating an unexpected lineage of people and works who became unwitting champions of the penumbra concept, including mathematician Johannes Kepler, feminist activist Estelle Griswold, British thinker Robert Hooke, and lexicographer Noah Webster. Pairing these stories with the writings of great legal thinkers such as Willam Douglas and Oliver Wendell Holmes, Schroeder is able to construct a kind of etymological love letter to this obscure concept. Not everyone has supported the privacy precedent, though, and it is no exaggeration to say that it is in danger today. Schroeder's clever, utterly unique history is, at its core, a call to redouble efforts to save the right to privacy. He argues that we must understand its ponderous, indeed uncertain, origins to fully appreciate the precarity in which it exists today, and only then can we adequately fight for it.

Floribert Bwana Chui, geb. 1981 in Goma im Osten der Demokratischen Republik Kongo, aufgewachsen in einer von blutigen Konflikten geprägten Region, lernte während des Studiums die Gemeinschaft Sant'Egidio kennen.
Tatkräftig engagierte er sich für Straßenkinder und in anderen Initiativen der Gemeinschaft. Im Juli 2007 wurde der junge Zollbeamte mit 26 Jahren ermordet, weil er der 'Versuchung des schnellen Geldes' widerstand und den Transport verdorbener Lebensmittel blockierte.

Bei den Überlegungen, die zu der symbiotischen Beziehung zwischen Friedrich Nietzsche und Franz Overbeck angestellt wurden, wer nämlich wen mehr beeinflusst habe, scheint die Antwort klar: Overbeck, dem es anders als Nietzsche an ruhmsüchtigem Ehrgeiz "bis zum Defekt mangelte", erscheint als der unselbstständige Adept seines jüngeren, genialischen Freundes. Die vorliegende Arbeit vertritt die gegenteilige Überzeugung, dass es vielmehr Overbeck war, der aufgrund seiner überlegenen Gelehrsamkeit die Agenda in dem nie abreißenden Gespräch zwischen den beiden Freunden vorgegeben hat. Wo in der Religionskritik Nietzsche draufsteht, ist Overbeck drin. Von den ersten beiden "Unzeitgemäßen Betrachtungen" Nietzsches bis zu seiner plagiierenden Spätschrift "Der Antichrist" sind die denkerischen Einflüsse Overbecks überall erkennbar, die auf der Folie intertextueller Vergleiche mit den bahnbrechenden theologischen Werken der Zeitgenossen Adolf von Harnack, Ernst Troeltsch sowie Julius Wellhausen in ein neues Licht gerückt werden und bis dahin Unsichtbares sichtbar machen.

Friedrich Schleiermachers christliche Sittenlehre wird vielfach als Kulturtheorie gedeutet, zumal alle wesentlichen Lebensbereiche im Bezug zum Christentum untersucht werden. Dabei geht Schleiermacher äußerst systematisch vor: So beruht seine Kulturtheorie des Christentums auf einem handlungstheoretischen Fundament (und ist nach drei Typen des Handelns unterteilt). Folglich finden sich reichlich Material und zugleich Begrifflichkeiten sowie systematische Zusammenhänge zur weiteren Reflexion und Erforschung. Mithin beschäftigen sich viele Beiträge des Bandes mit Interpretationen der christlichen Sittenlehre - auch vor dem Hintergrund der weiteren Entwicklung der Moderne. Dass Schleiermachers theologische Ethik es wert ist, aus verschiedenen Blickwinkeln erneut interpretiert zu werden, rechtfertigt die Entstehung einer neuen Edition. 1843 hatte sein Schüler Ludwig Jonas eine verdienstvolle, aber nach heutigen Editionsstandards nicht mehr geeignete Publikation der Vorlesungsmanuskripte Schleiermachers und der studentischen Nachschriften in kompilierter Form herausgegeben. In Zukunft werden die Manuskripte und alle überlieferten studentischen Nachschriften digital und historisch-kritisch erfasst zugänglich sein. Überlegungen zur neuen Edition eröffnen daher den Band. Da Schleiermacher mehrere Disziplinen in einem systematischen Zusammenhang beforschte und unterrichtete, sind viele Anhaltspunkte für Kontextualisierungen gegeben. Einige der Aufsätze stellen die christliche Sittenlehre mit anderen Disziplinen aus Schleiermachers Werk ins Verhältnis, andere gehen darüber hinaus und stellen auch einen Bezug zu aktuellen Themen her.&nbsp;

Studien zu Schleiermachers christlicher Sittenlehre

This book analyses recent developments in English corporate restructuring law from a range of comparative and theoretical perspectives, exploring some of the most difficult aspects of the design of domestic restructuring laws and their application in cross-border cases. Recent reforms to English law took place against the backdrop of corporate restructuring law reform initiatives in Europe and in many other regions of the world. These reforms reflect an emerging consensus as to the importance of such laws, both as a complement to macroeconomic stabilisation tools in times of extraordinary crisis, and as a determinant of investment conditions in more ordinary times. But it is one thing to recognise the importance of such laws in the abstract, and quite another to work out precisely how corporate restructuring rules should be designed. This book explores some of the most complex aspects of designing such rules. It does so primarily through the close analysis of the changes made by the enactment of the Corporate Insolvency and Governance Act 2020 (UK), and the interpretation of the new statutory provisions by the courts, although chapter authors draw extensively on examples from other jurisdictions to critically analyse choices made in the UK, and in some cases offer separate evaluation of restructuring law reform processes outside the UK, including in select jurisdictions in the EU and in Africa, and in the US. By drawing on experiences in other jurisdictions, and on insights from theory, the book casts new light on recent developments in English law, suggesting many avenues for further research and a range of implications for policymakers. These implications are brought out in an introductory chapter by the editors introducing the landmark 2020 reforms. This chapter provides a detailed synopsis of each chapter of the book, drawing out connections between them, and articulates some themes that run through the chapters that are salient for policymakers.

Corporate Restructuring Law in Flux

This book delves into the core debates of criminal law, examining fundamental principles such as legality, protection of legally protected goods, culpability, and proportionality. It reinterprets these principles through a lens of a Rawlsian theory of justice, proposing them as deontological liberalistic principles of justice. The book explores the influence of enlightenment thought and social contract theory which have sophisticatedly evolved so far on criminal law, suggesting that these principles can be derived from a hypothetical agreement under fair participation conditions.
Covering a wide range of topics, the book addresses human dignity, culpability, and the prohibition of analogy in criminal law interpretation. It engages with classic and ongoing debates, including free will, legal indeterminacy, and the jurisprudential implication of philosophies of Wittgenstein and Gödel. Additionally, it critically examines some theoretical issues, including collective guilt, criminal liability of electronic person, psychopathic offender, and conscientious objectors, as well as such doctrinal issues as mistaken self-defence and criminal complicity. A chapter on the origins of the penal system provides an in-depth account based on ancient Near Eastern customs and the Hammurabi Code, enriched by the latest evolutionary research. This interdisciplinary approach offers a comprehensive understanding of the nature of punishment.

Drawing on the experience of recognised experts from across a range of different fields and jurisdictions, this landmark publication tackles default rules in private law in comparative perspective. Often underestimated, but highly influential, default rules are non-mandatory rules that kick in where nothing else has been agreed or provided.
