Als Körperschaften des öffentlichen Rechts gelten besondere – insbesondere gesetzliche und damit regulatorische – Anforderungen für diese Träger. Die Einführung des freien Kassenwahlrechts Mitte der 1990er-Jahre und die Etablierung des Gesundheitsfonds 2009 hat zu einem Verdrängungswettbewerb geführt, der sich in einer Reduzierung der Anzahl der Krankenkassen manifestiert hat: Knapp 100 Krankenkassen versuchen derzeit die Versorgung für rund 72 Mio. Versicherte zu organisieren. Die Anforderungen an das Management dieser Einheiten sind damit deutlich gestiegen und zudem fallen weitere neue Aufgaben auf die Krankenkassen und Pflegekassen zu. Damit erstrecken sich die Aktivitäten der Kranken- und Pflegekassen unmittelbar auf zwei der insgesamt drei Gesundheitsmärkte: Versicherungsmarkt, Markt der Versorgungsverträge und zu guter Letzt der Leistungsmarkt.
