The Right to Strike Reimagined

Master's Thesis from the year 2025 in the subject Leadership and Human Resources - Recruiting, grade: 1,2, University of Applied Sciences Dortmund, language: English, abstract: This master's thesis explores the role of artificial intelligence (AI) in modern recruitment processes with a particular focus on applicants' trust. As digitalization and AI increasingly transform the world of work, organizations are adopting AI-supported recruiting tools to enhance efficiency, standardization, and data-driven decision-making. At the same time, the use of AI in personnel selection raises important questions regarding transparency, fairness, and acceptance from the applicants' perspective.

The objective of this thesis is to examine how applicants perceive AI-assisted recruitment processes and which aspects are relevant for the development of trust in this context. To address this research objective, a qualitative research design was chosen. Semi-structured interviews were conducted with participants who had either experienced AI-supported recruitment processes or reflected on their expectations toward such processes.

The empirical data were analyzed using qualitative content analysis following Kuckartz' approach. This method allows for a systematic examination of subjective perceptions, attitudes, and evaluations, while combining theory-driven and data-driven coding. The analysis focuses on applicants' experiences with different forms of AI usage in recruitment, their expectations toward human and technological decision-making, and their assessment of AI-supported processes within the broader candidate journey.

By linking theoretical concepts of trust in technology with empirical insights from applicants, this thesis contributes to the growing body of literature on AI in recruiting. In addition, it provides a structured foundation for further academic research and offers valuable insights for organizations seeking to better understand applicant perspectives on AI-supported recruitment processes.

Die Soziologie verfügt über vielfältige Perspektiven und Theorien, mit denen sie die Kriminalität als soziale Erscheinung beschreibt und erklärt. Tagung Junge Arbeitsrechtswissenschaft

Der vorliegende Tagungsband versammelt die Beiträge der 14. Tagung Junge Arbeitsrechtswissenschaft, die vom 10. bis 12. Juli 2025 an der Universität Leipzig stattfand und unter dem Generalthema "Herausforderungen der Transformation an das Arbeitsrecht" stand. Neben dem Festvortrag von Frau Inken Gallner, Präsidentin des Bundesarbeitsgerichts, enthält der Band Beiträge des wissenschaftlichen Nachwuchses, die aktuelle Transformationsprozesse des Arbeitsrechts aus unterschiedlichen Perspektiven analysieren.

Im Mittelpunkt der Beiträge stehen u.a. die tiefgreifenden Veränderungen, denen das Arbeitsrecht durch die fortschreitende Digitalisierung ausgesetzt ist. Eine besondere Rolle spielt dabei die Einführung von Künstlicher Intelligenz in Arbeitsprozesse, die neue rechtliche Fragestellungen im Hinblick auf Mitbestimmung aufwirft. Daneben wird auch die fortdauernde europäische Integration als strukturelle Herausforderung für das nationale Arbeitsrecht unter verschiedenen Aspekten untersucht, und zwar u.a. in Bezug auf die Themen Vorabentscheidungsverfahren in arbeitsgerichtlichem Kontext, der Work-Life-Balance oder der Entgelttransparenz.
Schließlich fand die Tagung in einem Kontext statt, in dem politische Entwicklungen und Erosionen einer liberalen Demokratie eine Rolle spielen. Es stellt sich die Frage, ob und inwieweit das Arbeitsrecht hierauf reagieren kann und welche Instrumente es dafür bereithält. Der Tagungsband greift auch diese Fragestellung auf und dokumentiert sie in besonderer Weise durch die schriftliche Fassung des Vortrags der Festrednerin.
Der Band leistet einen Beitrag zur wissenschaftlichen Auseinandersetzung mit den aktuellen und zukünftigen Transformationsanforderungen des Arbeitsrechts und richtet sich an Forschende, Lehrende sowie fortgeschrittene Studierende, mit einem Schwerpunkt im Arbeitsrecht, jedoch auch darüber hinaus.

Herausforderungen der Transformation an das Arbeitsrecht

A practitioners' text providing a summary of the law as it relates to insurance claims, largely, but not exclusively, addressing claims against insurers and insurance brokers specifically aimed at those involved in the application of the law on a daily basis, whether as solicitors, barristers or insurance claims handlers. 

Explaining the meaning of terms and concepts in plain English making it accessible to lawyers and non-lawyers alike, the 5th edition is fully revised and updated taking account of all significant new case law, including those being appealed to the Court of Appeal.

In addition to important insurance case law caused by the Covid 19 pandemic ,eg Rockliffe Hall v Travelers Insurance Co Ltd, Stonebridge Pub Company v MS Amlin, Various Eateries Trading Ltd v Allianz, and Greggs plc v Zurich, where a range of issues have been decided, other significant cases analysed in the 5th edition in detail include:

- Berkshire Assets v AXA in relation to avoidance for breach of the duty of fair presentation under the Insurance Act 2015
- Quadra Commodities SA v XL Insurance Company SE in relation damages for late payment of insurance claims under s.13A of the Insurance Act 2015
- Jones v Zurich in relation to avoidance of an insurance policy under the Consumer (Insurance and Disclosure) Act 2012

In addition Chapter 17, Specific Types of Insurance , is expanded to include a new section on cyber insurance.

Beiträge zum Arbeitsrecht

Christoph Boës first examines the question of the conditions under which an employee is entitled to receive remuneration even though they were temporarily unable to work due to a disruption in normal business operations (the so-called impossibility of acceptance). Under current law, both sentences 1 and 3 of § 615 BGB appear equally relevant. Which of the two provisions applies depends decisively on whether default in acceptance is excluded by the simultaneous occurrence of impossibility of performance. On the basis of a historical and teleological analysis, the author concludes that this question must be answered in the negative for general contract law as early as 1 January 2002. Accordingly, default in acceptance inherently also covers employment law constellations involving impossibility of acceptance. By contrast, § 615 sentence 3 BGB proves to be merely a declaratory reference to the requirements of sentence 1. Boës then turns to the limits of the employee's claim to continued remuneration. An exclusion of the claim may be considered in particular where the cause of the disruption does not affect only a single business but impacts a large number of businesses on a widespread basis. Up to now, no convincing solution to this problem has been found. The author proposes a delineation based on the concept of default in acceptance, which should capture only those impediments to performance that lie "in the person" of the creditor. The counterpart to this, in the view of the legislature, consists of purely objective impediments to performance. By abstracting from any conduct of the debtor or creditor, such impediments can be identified with legal certainty in individual cases by reference to the specific contractual performance owed.

This book examines the origins, deployment, and legacy of Order 1305, a measure introduced in 1940 to make it a criminal offence to take part in a strike. Surprisingly, the prohibition on the right to strike was retained by the Attlee administration after the Second World War, and was transformed to become a weapon of government during the Cold War to deal with what were wrongly claimed by ministers to be Communist-inspired strikes engineered for subversive purposes. In a deep analysis of Order 1305, the authors provide a reassessment of the role of the State in industrial relations. Challenging much contemporary learning in labour law, the book is informed by a very detailed engagement with Cabinet and ministerial papers, which highlight the contradictions on the part of government in simultaneously promoting and containing trade union power. These sources also highlight the extent to which trade unions both relied on and were co-opted by the State. The main focus of the book, however, is the role of Order 1305 in the control of trade union activists, with the continuing presence of the criminal law and allegations of communist inspired strikes ensuring an important role for MI5 and Special Branch in post-war industrial relations. Material unearthed at the National Archives demonstrates unequivocally not only that trade unions were deeply penetrated, but also that trade union activists were the subject of extensive surveillance, as the authors fully reveal.
