Discourses of Justice - Indicators of Crisis?

This book analyses recent developments in English corporate restructuring law from a range of comparative and theoretical perspectives, exploring some of the most difficult aspects of the design of domestic restructuring laws and their application in cross-border cases. Recent reforms to English law took place against the backdrop of corporate restructuring law reform initiatives in Europe and in many other regions of the world. These reforms reflect an emerging consensus as to the importance of such laws, both as a complement to macroeconomic stabilisation tools in times of extraordinary crisis, and as a determinant of investment conditions in more ordinary times. But it is one thing to recognise the importance of such laws in the abstract, and quite another to work out precisely how corporate restructuring rules should be designed. This book explores some of the most complex aspects of designing such rules. It does so primarily through the close analysis of the changes made by the enactment of the Corporate Insolvency and Governance Act 2020 (UK), and the interpretation of the new statutory provisions by the courts, although chapter authors draw extensively on examples from other jurisdictions to critically analyse choices made in the UK, and in some cases offer separate evaluation of restructuring law reform processes outside the UK, including in select jurisdictions in the EU and in Africa, and in the US. By drawing on experiences in other jurisdictions, and on insights from theory, the book casts new light on recent developments in English law, suggesting many avenues for further research and a range of implications for policymakers. These implications are brought out in an introductory chapter by the editors introducing the landmark 2020 reforms. This chapter provides a detailed synopsis of each chapter of the book, drawing out connections between them, and articulates some themes that run through the chapters that are salient for policymakers.

This book offers a detailed analysis and reappraisal of Michel Foucault's work on power, law, and society.Highlighting the ambiguities, tensions, inconsistencies, and transformations in Foucault's work, the book shows how, in Foucault's later years, his ideas gradually converged toward a conception of power that was significantly different from the one that emerges from the works and courses of the mid-1970s, and which came to provide the mainstream understanding of his thought. From the vantage point of this later conception, the book is then able to reframe the tensions and inconsistencies in Foucault's thought as parts of a multiplex but coherent conceptual system. Foucault's theses on the development of techniques of power since the 18th century, and on the impact of these developments affected the structure of modern law, are then reformulated to offer a more comprehensive and more balanced appraisal of their significance.Foucault on Power, Law, and Society will appeal to theorists in law, philosophy, and political science, as well as others with interests in the perpetually influential work of Michel Foucault on power.

This book is an invitation to pause and wonder at the spectacular yet mundane practice that we have come to call legal sightseeing.Increasingly, international courthouses are becoming top tourist destinations that host public events, exhibitions, and tours. But international law also pops up in more everyday spaces: as the theme for an organised city run or as a symbol printed on a T-shirt or an image on a cookie jar. Legal sightseeing stands for this broad category of encounters between 'international law' and 'the public' that encompasses many different activities, sites, artefacts, and participants. The book presents a rich collection of images and research that introduces legal sightseeing as both the phenomenon under study and an experimental research methodology. Structured as a catalogue, the book covers a wide range of iconic and surprising instances of legal sightseeing, located, for example, at the former American Embassy in the Netherlands, the Museum of White Terror in Taipei, in Bulgaria's capital city, Sofia, and at more traditional sites such as the Peace Palace in The Hague and Courtroom 600 in Nuremberg. Moreover, every chapter advances a particular aspect of legal sightseeing as an innovative, visually oriented, and collaborative method of research. By revisiting a selection of projects curated under the legal sightseeing umbrella, the book contributes to academic discussions on international law's visual turn, its spaces and materiality, and the plurality of international law's audiences. Concretely, it offers readers hands-on examples of how to integrate art-based methods such as collaging, drawing, and photography into legal research and teaching practices.Legal Sightseeing and International Law is an interdisciplinary catalogue that will be a timely resource to students of public international law, politics, and art. Terms such as supranationality, confederation of states, or federal state were regarded as shaped by the nation-state and as polarizing. Linguistic innovations, distinct linguistic rules for European law, and a language of imagery and metaphor were needed. A linguistic transformation took place-a transitional period (a

 ) that continues to shape how we communicate about European law today. The term 
 Sattelzeit
 is coined in reference to the conceptual historian Reinhart Koselleck and denotes a particularly profound shift in language. With this European 
 Sattelzeit
 , indeterminate associative terms and modes of expression became established in European law that raise difficult questions-for example, whether European law and national law constitute one, two, or several legal orders; whether European law has its own source of law; whether it was created through an overarching act; or whether it is a "community of law." Such formulations have not only made the specialist language of European law more confusing, but presumably also more political. The approach of the present study is both historical-critical and analytical. Who used which legal expressions, for what purpose?
