Der umweltvölkerrechtliche und europarechtliche Rechtsdurchsetzungsanspruch als Lösungsinstrument für Individualkläger?

Esta nueva y segunda edición del libro de Serviliano Abache Carvajal, sobre De la parafiscalidad venezolana del siglo xxi. Enfoques desde la teoría general del tributo, ha sido provocada por el dinamismo normativo de la parafiscalidad en Venezuela, pasando por reformas legales y administrativas, a la vez que la promulgación de una inédita contribución.Desde cuando se publicó la primera edición en 2022 y hasta la actualidad, no han sido pocos los cambios experimentados en el panorama parafiscal venezolano, concretándose, entre otros, en la publicación de reformas legislativas (Ley de la Actividad Aseguradora de 2023, con cambios en su contribución especial), en nuevas leyes (Ley de Protección de Pensiones de Seguridad Social, reguladora de una controvertida "contribución especial"), le emisión de nuevas regulaciones administrativas (Providencia 015-004-2024 del Fondo Nacional de Ciencia, Innovación y Tecnología y Providencia SAA-01-0510-2024 de la Superintendencia de la Actividad Aseguradora), por sólo mencionar los cambios normativos relativos a las contribuciones parafiscales abordadas en la obra. También se han concretado nuevas prácticas administrativas, como la reciente tendencia sancionadora mediante reparos virtuales de escritorio en torno a la Ley de Protección de Pensiones de Seguridad Social. Lo anterior llevó a revisar lo desarrollado en la primera edición y, con ello, preparar esta segunda edición, ahora actualizada y ampliada.
El enfoque adoptado se centra en ofrecer algunas ideas, consideraciones, reflexiones y propuestas que no se queden en un plano de exclusivo corte teórico y conceptual, sino -y especialmente- que más bien tengan utilidad práctica para los contribuyentes&amp;

This book is the first investigation of the relationship between EU digital sovereignty and sustainability strategies. It maps the ambitions and limitations of EU digital strategic autonomy and explores the structural challenges underlying its relationship with its green transition objectives in the context of the ongoing wars in neighbouring European countries and the consequent tensions in the EU energy sector. The EU is racing to achieve technological independence from third countries and foreign multinational companies to protect its digital sovereignty and preserve its fundamental rights. In the EU, digitalisation and the green transformation are seen as twin transitions. Yet, EU digital sovereignty strategies have a significant environmental cost. Reaching a status of strategic autonomy of the EU at the level of digital infrastructures, products, services and data implies higher energy consumption and exploitation of natural resources. Governments around the world are privatizing everything, with dramatic but largely ignored negative consequences for human rights. This open access book outlines the response that is urgently needed. Corporations are being given control over water, healthcare, housing, public transportation, child welfare services, aged care, and much else. Privatization is promoted by international financial institutions, consulting firms, and development actors as the answer to public finances devastated by the very tax cuts insistently pushed by these groups. Their pitch is based upon a mythology that extols the virtues of an idealized market while ignoring the heavy human rights costs incurred. Building on the latest evidence and on specially commissioned case studies, this book shows how the touted 'efficiency' of the private sector is often predicated on higher charges and/or reduced services, destructive employment practices, and the highly predictable exclusion of many users. Privatization generally costs states more money, marginalizes democratic decision-making, and transforms citizens from rights-holders into customers while sidelining accountability. The authors develop an approach designed to enable human rights actors, including courts, UN treaty monitoring bodies, and NGOs to move beyond their longstanding agnosticism towards privatization. It starts with a presumption that privatization is inherently retrogressive in human rights terms. Whatever mix of public and private is reflected in any given arrangement, governments must retain the degree of control necessary to ensure respect for rights, and the legal, financial and administrative ability to do so.
