This open access book investigates the role played by copyright on the digitisation of cultural heritage from three angles: the theoretical differences between cultural property law and copyright; a comparative analysis of the EU, UK, and US; and analysis of current practices and concerns, based on empirical research. As heritage digitisation projects become increasingly common for purposes such as preservation and access, the impact of copyright is also becoming more problematic. In order to provide a full and current picture of the copyright problem, the book first introduces the reader to the debates on the scope and ownership of cultural heritage and provides an overview of the copyright implications of the digitisation process and newer uses, including 2D and 3D scanning; virtual and augmented reality; text and data mining; and artificial intelligence. The author then divides the main critical analysis into three parts, referred to as the 'clashes with copyright'. The first, clash in theory, lies between cultural property law and copyright justification theories. The second clash is in the different legal approaches to digitising in-copyright, public domain, orphan, out-of-commerce and unpublished works in the chosen jurisdictions, focusing on the relevant rights and defences. The third clash is in the interests of stakeholders, based on public reactions to existing projects and cases, supported by interviews with heritage professionals engaging in digitisation. By placing itself in this particular intersection of law, heritage, and technology, the book will be of interest to both intellectual property academics and cultural heritage professionals. This book challenges the near-universal acceptance of a US-style, Western constitutional paradigm as the best basis for comparative constitutional studies. It does so on three main grounds: anachronism, 'othering' and cultural specificity. Main pillars of 'convergent constitutional theory' are rooted in the revolutionary, late-eighteenth century - a lost world; constitutional arrangements that deviate from the paradigm are often branded as 'outliers' or even as not constitutional at all; and the foundations of the paradigm in liberal democracy give no space for other forms of constitutionalism. Whatever the attractions of convergent theory as a normative ideal of good government, for the purposes of understanding, analysing and explaining constitutional systems it is far from ideal. This book discusses and questions: convergent theory's weddedness to writing as the technology of constitution-making; its image of a constitution as fundamental law; its idea that a constitution expresses the 'sovereignty of the people'; its use of tripartite separation of powers as the basic principle of institutional design; its relative neglect of administrative law; its association of 'rights' with judicially enforceable bills of rights; and its obsession with a vaguely specified concept of 'democracy'. It makes suggestions for alternative, preferable methods of understanding, analysing and explaining constitutions, and governmental and constitutional systems.

The Philosopher in the Valley

Master's Thesis from the year 2025 in the subject Leadership and Human Resources - Recruiting, grade: 1,2, University of Applied Sciences Dortmund, language: English, abstract: This master's thesis explores the role of artificial intelligence (AI) in modern recruitment processes with a particular focus on applicants' trust. As digitalization and AI increasingly transform the world of work, organizations are adopting AI-supported recruiting tools to enhance efficiency, standardization, and data-driven decision-making. At the same time, the use of AI in personnel selection raises important questions regarding transparency, fairness, and acceptance from the applicants' perspective.

The objective of this thesis is to examine how applicants perceive AI-assisted recruitment processes and which aspects are relevant for the development of trust in this context. To address this research objective, a qualitative research design was chosen. Semi-structured interviews were conducted with participants who had either experienced AI-supported recruitment processes or reflected on their expectations toward such processes.

The empirical data were analyzed using qualitative content analysis following Kuckartz' approach. This method allows for a systematic examination of subjective perceptions, attitudes, and evaluations, while combining theory-driven and data-driven coding. The analysis focuses on applicants' experiences with different forms of AI usage in recruitment, their expectations toward human and technological decision-making, and their assessment of AI-supported processes within the broader candidate journey.

By linking theoretical concepts of trust in technology with empirical insights from applicants, this thesis contributes to the growing body of literature on AI in recruiting. In addition, it provides a structured foundation for further academic research and offers valuable insights for organizations seeking to better understand applicant perspectives on AI-supported recruitment processes.

Artificial intelligence in the recruitment process. How can companies gain applicants' trust?

This open access book critically analyses a wide range of consumer law issues generated or exacerbated by the Internet of Things. The Internet of Things challenges many of the dichotomies which have shaped current laws: goods-services, hardware-software, tangible-intangible, online-offline. The book focuses on 4 specific challenges: things-as-service, liability, bricking of physical devices through software control, and the potential for enhanced personalisation, especially for digital assistants. The chapters analyse specific applications such as smart homes, connected cars, and consumer wearables with a view to providing innovative solutions to the new challenges posed by the Internet of Things, and to steer the development of the Internet of Things in a fairer direction. As well as offering an important analysis of the potential for smart consumer laws in the Internet of Things, the book also provides important insights into the growing divergence between Germany's and the UK's consumer laws since Brexit.
