The law codes in the Middle East North Africa (MENA) region are a well-crafted blend of civil and Islamic law in which civil law principles do not violate Islamic provisions. Yet, common law principles derived either from English common law or Islamic customary usages remain unidentified and thus ignored. Here, this complex scenario is rectified through a comparative analysis of the primary data (e.g. cases, statutes and arbitral award decisions), adding common law and uncodified Islamic custom to MENA law codes. The purpose of this comparative analysis is to allow common legal principles found in civil, common and Islamic law to be distilled in order to create a new, harmonised international commercial arbitration law code (HICALC) or uniform Arab arbitration law (UAAL) for adoption in the MENA region, where these principles already greatly influence the legal systems and can be readily assimilated into a harmonised or uniform code. The work demonstrates that this new code would lead to improved arbitral award enforcement in the MENA.

Why do some international courts wield broad authority while others face pushback or fade into irrelevance? This book provides novel theoretical and empirical insights into this question. It offers a fresh, interdisciplinary perspective on the authority of international courts, drawing from law, political science and behavioural research. It develops, in Part I, a theoretical model and analytical framework for assessing these questions. The model explains how authority relationships between courts and their audiences - such as states, NGOs, individual applicants, and domestic courts - are formed, maintained, or contested. The book uncovers the dynamic relationship among China, the West, and the giant panda, rooted in over two centuries of cross-cultural encounters.Drawing from extensive fieldwork at the Chengdu Research Base of Giant Panda Breeding, the book explores how panda fandom has evolved as a result of China's participation in global capitalism, cultural exchange, and diplomatic strategy. This book aims at showing that panda fandom, although taking its shape in the Chinese nation currently, has been a consequence to the expansion of Western imperialism, colonialism, and capitalist industrialization in the Chinese community since the 18th century. It undertakes the task of inquiring how the Chinese communities, through the figure of the giant panda, have responded and made sense of this modern transformation. The book is loosely organized around the chronological order of the development of the panda fandom and can be divided into two parts. The first part explains the emergence of the panda fandom, and the second part deals with interviews. Through a rich blend of personal narratives, historical documents, daily observations, and carefully crafted interviews, it provides a fresh perspective on how cuteness, biopower, and nationalism shape both Chinese identity and the lived experiences of these fans.
