The Rule of Law in Context

This book investigates core legal-political cultural myths of the Australian nation by canvassing, challenging and recasting some of the well-understood debates around, and invocations of, 'the rule of law' in Australia. It foregrounds one of the most enduring and prominent manifestations of these debates: claims to state sovereignty and rule of law in a system that has an incoherent legal foundation in its intentional ignorance of, and arbitrary violence perpetrated against, First Nations, their people, their sovereignty and their law. It examines the claims and celebrations of colonial rule of law achievements; constitutional rule of law protections; and the rule of law as tool to delineate and circumscribe the role of judges in the State. It presents a survey of the constitutional and legal principles and institutions and explores the socio-political aspects of rule of law in the country and how rule of law is experienced. With a focus on the legacy of the treatment of First Nations people, the book looks at how the Australia's rule of law institutions and machinery continue to exclude and fail vulnerable, marginalised and publicly reviled groups. Exploring these arguments through historical and contemporary case studies, including native title negotiations, anti-terrorism regimes, the government's response to the COVID-19 pandemic, the push for constitutional enshrinement of a First Nations Voice, and the Royal Commission into the government's 'Robodebt' inquiry, this book shows the inescapable messiness of rule of law in Australia as a legal and political concept, instrumentalised and weaponised across its history.

How visual fantasies of violence, animality, and political agency offered an alternative image of masculinity during the Enlightenment &nbsp; Centering on animal bodies and assertive masculinity, the visual strategies of hunting art may appear incongruent with our understanding of Rococo aesthetics and the early Enlightenment. But these themes, embraced with enthusiasm by artists and patrons, inspired artworks in every genre and medium in eighteenth-century France. As the country expanded its colonial empire, the absolute monarchy existed in tension with ambitious elites, and the Enlightenment eroded old certainties about selfhood and society, hunting art provided a visual language of personal and national sovereignty written with bodies of men and animals. Amy Freund revises our received notions of eighteenth-century French art and culture, confronting us with a visual culture of animality, violence, and death: a Rococo of dogs and guns. &nbsp; Noble Beasts highlights the work of François Desportes, Jean-Baptiste Oudry, and others who, operating from the heart of institutions such as the Royal Academy and the Gobelins manufactory, produced an astonishing volume of highly accomplished work. The book draws on the critical frameworks of human-animal studies and on Enlightenment philosophical debates to explore how and why hunting art’s aesthetic and political claims blurred the lines between human and animal.

This book examines how neoliberal power shapes individual subjectivity in contemporary American workplaces through the lens of the Great Resignation-the 2021 mass voluntary job departure phenomenon.Drawing on in-depth interviews and a Foucauldian framework, the book traces how neoliberal rationalities of choice, flexibility, and self-optimization shape the ways individuals explain their labor decisions and evaluate their lives. Rather than treating the Great Resignation as a singular rupture, the analysis situates it within longer historical transformations in governance, capitalism, and employment relations.The book identifies differentiated modes of labor subjectivity-alignment, negotiation, and refusal-showing how workers variously inhabit, strain against, or attempt to revalue dominant norms of work and responsibility. Across chapters, it demonstrates how quitting becomes intelligible not simply as resistance or market behavior, but as an ethical and discursive practice shaped by uneven opportunities, affective demands, and institutional constraints. In doing so, the book reveals both the durability and the limits of neoliberal labor governance.Offering a theoretically rich account of how labor and life might be reimagined, the book is intended for scholars and advanced students in sociology, critical psychology, labor studies, and social theory, as well as readers interested in work, governance, and contemporary capitalism.  Veronika Dolar
 is Associate Professor in the economics department at Pace University. She was born in Slovenia, which was within Yugoslavia. Dolar obtained her international baccalaureate in Italy at the United World College of the Adriatic and went on to graduate summa cum laude from Western University. She earned a PhD in applied economics from the University of Minnesota.&nbsp;
 Teresa Perry
 is Assistant Professor in the economics department at California State University, San Bernardino. She graduated from the University of California, Santa Barbara, with an undergraduate degree in economics and later obtained a master’s degree in economics from Colorado State University. Perry earned a PhD in economics from Colorado State University.

Following the Asian economic crisis of the 1990s, this is the first book to examine the structure and transformation of the labor markets and social stratification of contemporary East Asia, namely Japan, Korea, Taiwan, and China, focusing in particular on gender inequality. It deals with social mobility and gender differences in unemployment, temporary employment and self-employment. Additionally, gender segregation, social identity and suicide rates are also addressed. Taken together, the issues raised in this volume reinforce the advantage of a comparative approach to East Asian Studies. The findings, supported by strong statistical analysis, clearly call into question a longstanding view that East Asian gender regimes and class structure are homogeneous. Indeed, this is demonstrably not the case, as Labor Markets, Gender and Social Stratification in East Asia shows, revealing as it does considerable diversities in labor markets, gender regimes, and social mobility within East Asian societies due to historical and institutional differences. This book examines the long-term dynamics of urban labour market behaviour of women and men over three and a half decades, spanning the period from 1987-88 to 2023-24. It provides a detailed understanding of the topic by incorporating data and information that cover both the supply and demand sides of the labour market. The book distinguishes itself from similar studies by adopting a life-cycle approach for women so as to enable a holistic coverage of various dimensions that hamper or facilitate their economic participation at every stage of life. It examines the gender differences in labour market behaviour and outcomes of young graduate women, married working age women, as well as elderly women. It also undertakes a time-use analysis for understanding the impact of education on gender differences in the distribution of unpaid domestic responsibilities among adolescent girls and boys. Likewise, among the married women fully engaged in household work, the book explores the potential for their integration into the labour force if employment opportunities are accessible at their household. Combining quantitative analysis of secondary datasets with qualitative analysis of primary survey interviews, this study provides an evidence-based depiction of gendered labour market realities and the policy approach to address them. The qualitative approach uses narrative-building to capture the lived experiences of women and men employed in the public transport and sanitation sectors. Without re-examining its philosophical and conceptual foundations, there is a growing risk that sensemaking will collapse into conventional cognitive models of interpretation – models that are ill-suited to the complex, fluid realities of contemporary organizations.
