Whistleblowers: Voices of Justice

This book proposes a regulatory system for ensuring that AI makes fair decisions.

No one wants to be the subject of an unfair decision made by an AI, and fairness is so important to society that we are likely to want to regulate to demand it. But how? This book attempts to answer that question. 

The aim of regulation must be for an AI's decisions to match the human conception of fairness. To understand what that is, the book proposes a holistic understanding of fairness, which tells us what regulation must try to achieve.

However, regulation is not an abstract activity - it regulates how humans behave, and the humans in question are those who develop and use AI for decision-making. Thus the book investigates how those humans are attempting to achieve AI fairness. It finds that there is a serious mismatch between how technologists conceptualise fairness, compared to other humans. How can AI regulation bridge this gap?

Traditional models of regulation cannot solve this problem. Fairness is too nuanced, too contextual, and is ultimately a human emotional response. Instead the book proposes to place the responsibility on the AI community to explain and justify their efforts to achieve fairness, basing regulatory and legal responses on how well that explanation deals with the risks that particular AI presents, and whether the AI operates in accordance with the explanation in use.

The book concludes by examining how far this regulatory model might be useful for some of the other social problems which AI generates. 

An original and significant contribution to the literature on AI regulation, this book is a must-read for those working in the areas of law, regulation, and technology.

AI Fairness and Beyond

Routledge Critical Studies in Finance and Stability

The bank failures of the early 2020s challenged the view that the financial reforms implemented after the 2007-2009 financial crisis had strengthened the robustness of the financial system.Despite the commonly held belief that measures such as the Basel framework and Dodd Frank Act had provided the financial sector with an effective shield against disruption, this book argues that the failure of these reforms to prevent further financial crises was not inevitable. The book contextualizes the long history of financial instability, elucidating the features of capitalism's current phase that make it so prone to financial crises, and highlighting other periods (notably the post-war period) characterized by remarkable stability. The book draws on post-Keynesian analyses of the evolution of capitalism and the endogenous instability of capitalist economies - by Minsky in particular - and incorporates insights from French regulatory theory. From this perspective, financial crises are not the result of exogenous deviant behaviors on the part of ill-intentioned or incompetent agents but the result of the normal functioning of capitalist economies. In this respect, the 2007-2009 crisis and the bank failures of 2023 are manifestations of this endogenous financial instability. Preventing their resurgence requires an alternative understanding of financial instability, one that interrogates the intrinsic dynamics of the financial system, engages in a critical examination of extant regulatory frameworks, questions the effectiveness of resolution mechanisms, and considers the increasingly urgent climate-related financial risks.This book will be of interest to researchers working on issues of financial instability and regulation as well as money and banking more broadly.

Der Gesellschafter- und Geschäftsführerkreis einer Familiengesellschaft ist aufgrund der emotional aufgeladenen Beziehungen der Akteure besonders anfällig für Rationalitätsdefizite. Zahlreiche Beispiele aus der deutschen Wirtschaft zeigen, dass der Streit um die Verteilung der Macht und Vermögenswerte in der Familiengesellschaft insbesondere im Rahmen eines Generationenwechsels existenzgefährdend werden kann. Den Rationalitätsdefiziten zu begegnen ist für den nachhaltigen Erfolg der Familiengesellschaft damit essenziell. Während einige Familiengesellschafter vorbeugend umfassende Vertragswerke in und um die Gesellschaft errichten, finden sich nach wie vor Familiengesellschaften, die keine besonderen Regelungsmechanismen implementiert haben.Dieser Problematik steht mit der gesellschaftsrechtlichen Treuepflicht ein Instrument gegenüber, welches dem Verpflichteten die Berücksichtigung der Interessen der Gesellschaft und (Mit-)Gesellschafter auferlegt. Dabei werden Intensität und Umfang der Treuepflicht maßgeblich durch die Gesellschaft selbst sowie ihre Umgebung beeinflusst. Der Autor untersucht die Auswirkungen der besonderen Struktur und Umgebung der Familiengesellschaft auf die gesellschaftsrechtliche Treuepflicht.

This book considers what kind of binding force judicial decisions (should) hold in modern societies. It focuses on the two most prominent legal traditions, common law and civil law. It explores the developing trend in civil law countries to expand the influence of judicial precedents, discusses the fundamental issues which arise from this trend, and looks at recent developments in common law countries. Through this prism, the book looks at the implications of the doctrine of judicial precedents and how it is construed in jurisdictions that recognise it. It investigates the impact of newly recognised legislative or quasi-legislative powers vested in high courts on the doctrine of separation of powers. It considers whether courts in common law and civil law systems share a uniform understanding of precedents. The book goes on to consider whether these developments are beneficial when it comes to addressing existing challenges or whether they lead to a host of new problems, potentially exacerbating the crisis of judicial legitimacy. In relation to the hierarchical nature of civil law justice systems, it asks whether binding rulings from higher courts pose a potential threat to substantive judicial independence, limiting the open and pluralistic dialogue between lower and higher courts. It then goes on to reflect whether binding opinions from the highest judicial instances encroach upon the prerogatives of legislative bodies, resulting in the creation of suboptimal laws.

This book examines how the European bank recovery and resolution framework shapes bank governance and decision‑making, and how a clear and credible institutional regime for bank failure can strengthen banks’ resilience. It analyses the effects of the current resolution framework on bank governance by focusing on the ex‑ante expectations it creates for bank decision‑makers. Addressing a gap in the literature, the book shows how the new resolution regime for ailing banks has the potential to improve both the quality of bank governance and institutional resilience. However, the analysis reveals that such a potential is not fully exploited because of the complexity and the lack of credibility of the resolution framework.  &nbsp;is Associate Professor of Law at the Amsterdam Center for Law and Economics, University of Amsterdam and a Research Associate at the European Banking Institute (EBI). Before joining the UvA, Edoardo earned his PhD in Law and Economics at Erasmus University Rotterdam, an LL.M. from the European Master in Law and Economics – EMLE (with distinction) and Law Degree from University of Florence. He held visiting positions in several Universities, including the European University Institute, Goethe University Frankfurt, LUISS University, and Oxford University.
