Kaum ein biblisches Zitat ist so bekannt - und zugleich so missverstanden - wie 'Auge um Auge, Zahn um Zahn...'. Vor allem aufgrund der Auslegungsgeschichte seiner Rezeption im Matthäusevangelium wurde die Talionsformel zur Chiffre für Vergeltung. Diese Studie zeigt jedoch, dass die Formel weder in der Hebräischen Bibel noch im antik-jüdischen Diskurs als Chiffre für Vergeltung eingesetzt wurde. In den Schriften vom Toten Meer, bei Philo von Alexandrien, Flavius Josephus und in tannaitischer Literatur erscheint sie vielmehr in rechtlichen Debatten über angemessene Sanktionen und Verfahrensnormen. Das matthäische Zitat fällt allein durch die sonst nicht belegte paränetische Auslegung der talio aus dem Rahmen. Few biblical quotations are as familiar - and as misunderstood - as "an eye for an eye, a tooth for a tooth...". Owing largely the history of interpretation of its reception in the Gospel of Matthew, the talionic formula became a shorthand for retribution. This study demonstrates, however, that neither the Hebrew Bible nor Ancient Jewish discourse employed the formula as a code for retribution. In the Dead Sea Scrolls, Philo of Alexandria, Flavius Josephus, and Tannaitic literature, it functions within legal debates on appropriate sanctions and procedural norms. Matthew's use is distinctive only in genre, offering a parenetic interpretation of the talio.

This study centers on the Dutch Republic, where Roman law-applied alongside contemporary legislation-was used to regulate the lives of enslaved individuals across its territories, albeit in a highly selective manner. Which provisions of Roman law were implemented, and what led to the exclusion of others? This book investigates these questions through a historical analysis of the legal transfer of Roman law within both the metropole and the colonies. Special attention is given to the private law governing enslaved persons in the Dutch Republic and its overseas territories, including the WIC¿administered islands of Curaçao, Aruba, and Bonaire, the Sociëteit van Suriname, and the VOC¿controlled Cape Colony. The 2012 BellagiöHarvard Guidelines on the Legal Parameters of Slavery identify legal institutions grounded in the notion of ownership, providing a valuable framework for legal¿historical research on slavery.

The Legal Framework of Slavery in the Dutch Republic and Its Colonies

This book excavates the often neglected role of the Polish government-in-exile within the Allied war crimes trial programme and post-1945 international law. Drawing on newly examined archival sources and biographies of key émigré lawyers, it reveals how Polish and other European jurists helped define the concept of accountability for wartime atrocities long before the Allies convened at Nuremberg. Combining legal and historical approaches, this book traces the Central and Eastern European influences on the UN War Crimes Commission and Allied policy, showing how their ideas about justice, responsibility, victim's perspective, and law continue to resonate in modern interpretations of the legacy of Nuremberg.

A Legal and Historical Analysis

Accountability for War Crimes in the Policy of the Polish Government-In-Exile

The dramatic story of how a small neighborhood in Connecticut became the site and symbol of a political conflict over the use of eminent domain, mobilizing a national property rights movement. In 2000, Susette Kelo and other residents of the Fort Trumbull neighborhood sued the city of New London, Connecticut. Two years earlier, the pharmaceutical giant Pfizer had built a facility adjacent to this area. Shortly thereafter, the city empowered the privately owned New London Development Corporation to use the power of eminent domain to implement a “comprehensive redevelopment plan” for the neighborhood. While the plaintiffs argued that economic development did not qualify as a valid “public use” under the Takings Clause of the Fifth Amendment, the Supreme Court decided in a controversial 2005 decision that the potential economic benefits of the plan justified the condemnation of private property as long as appropriate compensation was paid. The Kelo decision implied that any town could transfer property to private developers on the grounds of possible future tax revenue and job creation, so long as that action was included in an economic development plan. The outrage over the decision unleashed a near-unanimous backlash, even resulting in an executive order from President George W. Bush instructing the federal government to limit the use of eminent domain. Numerous states passed ballot initiatives and legislation restricting eminent domain in the wake of the Kelo case. Despite this outcry, urban planners and others defended it as a necessary application of existing precedent that allowed cities flexibility to combat economic downturns. Lead plaintiff Susette Kelo and her pink house became a symbol of a growing national property rights movement and a deepening conflict between public officials and property owners, between large corporations and local communities. Perhaps most disastrously, after bulldozing the neighborhood the developer was unable to secure the necessary financing and abandoned the project, leaving empty lots where the plaintiffs’ properties once stood. It would be many years before a feasible plan led to actual new construction and improvements. Not for Sale recounts this iconic episode in recent legal history, giving full attention to both the human and legal elements of the story and offering a balanced consideration of each. The story remains as relevant as ever, especially since the Supreme Court has repeatedly refused to reconsider its decision, most recently in Bowers Development, LLC v. Oneida County Industrial Development Agency (2025).

Later, after donning his black robe, he reshaped jurisprudence with precedent-breaking rulings – on issues ranging from women's rights to consumer protection to education reform – and breaking trail when he ordered the shutdown of the Reserve Mining Company in northern Minnesota, which was spewing its waste into Lake Superior, in the most sensational trial of the early environmental era.One of Judge Lord's landmark cases – and interlaced as a centerpiece narrative of this book – involved the Dalkon Shield intrauterine device, which caused horrific infections in thousands of women, resulting in infertility and sometimes death. Author Roberta Walburn served as the judge's law clerk during that litigation in 1983–84, and she provides a page-turning account (both an insider's view and an in-depth chronicle) of what was called "one of the most disastrous episodes of American corporate misconduct." In the end, more than 200,000 women received nearly $3 billion in compensation, and the Fortune 500 defendant was left in ruins. But Judge Lord was hauled up on judicial misconduct charges for his no-holds-barred actions that were certainly provocative but also stand as a timely reminder, even (or especially) today, of the challenges in balancing the scales of justice for a legal system that too often skews to the rich and powerful.The author deftly weaves the Dalkon Shield drama into the larger story of the life of a one-of-a-kind man, crafting a sweeping and spirited true-life tale with not only her first-hand experiences as the judge's law clerk but also with unrestricted access to the judge's personal files.
