Understanding China

The book comprehensively explores the origins, structure, characteristics, functions, and unique role of Chinese legal tradition within the global scope of legal culture. It adopts a thematic framework that extends across multifaceted dimensions to examine the evolution, features and impact of Chinese legal culture, breaking away from the traditional chronological approach to legal history.


The book seamlessly integrates macro and micro views, bridges ancient and modern, as well as Chinese and foreign perspectives, and combines state law with folk law, and law with ethics. The content covers seven key aspects: the culture of rites and etiquettes, penal culture and practice, the culture of legal philosophies, the culture of a legal system, contractual culture, the culture of mediation, and the culture of justice. The topics encompass the origins of traditional Chinese law, the evolution of legal thoughts, the development of legal systems, the procedures and effects of legal practices, and the relationship between legal development and social change.


This book is primarily aimed at legal scholars, students, and practitioners who are interested in understanding Chinese traditional legal culture. It is also intended for readers with a moderate level of education or higher, who seek to understand Chinese legal history and culture.

Traditional Legal Culture in China

This collection of essays presents a socio-legal history of epidemics from the medieval period to the present day. Building on previous studies of infectious diseases undertaken by social historians of medicine, this collection explores the histories of epidemics and disease by looking at the legal measures deployed against them. Whilst previous works have considered the mechanisms by which legal change occurs, the social and political assumptions on which new laws and new legal structures are premised and the social changes which follow, this book focuses on the way in which historical actors understood law to be a complex means of responding to disease and the way in which that law shaped (and limited) the responses which could be made to disease. Taking an interdisciplinary approach, it features contributions from scholars across a range of academic disciplines who consider the wider implications of epidemics and disease beyond the obvious health effects. The collection focuses first on regulatory responses such as the quarantine laws and border policies in the eighteenth century, the framing of 'disease' in the Colonial Immigration Acts in the nineteenth century and the ethics of public health in the twentieth century in Great Britain. It then goes on to consider developments in broader legal doctrine which themselves resulted from social and/or legal responses to disease, including the centralisation of labour regulation in the wake of the black death, property disputes about leper houses, pest houses and fever hospitals, and the prosecution of medical professionals for disease transmission in 19th century England. Methodologically all the chapters are historical, but a range of approaches has been taken, from quite traditional doctrinal legal history through socio-legal history to traditional political and social history, to bring the history of epidemics and the legal measures deployed against them in to sharp focus.

This book delves into medico-legal history, travelling back in time to explore English law's fascinating and often acrimonious relationship with healing and healers. Challenging assumptions that medical law is a recent development, Law and healing traces the regulation of healers from the Church's dominance to legal battles fought among medical practitioners. As well as considering the history of the regulation of healers, this book addresses moral issues such as abortion, bodily sovereignty, and the use of cadavers in research. It highlights how fundamental legal and ethical questions continue to resurface, for example, from controversy in the Renaissance over human dissection to modern-day debates about organ donation. Law and healing provides a colourful but critical account of the longstanding - and often fraught - relationship between two fundamental pillars of human society.

As pauperism and begging dramatically increased throughout Europe in the sixteenth century, poverty began to be treated as the object of governmental regulation rather than of individual benevolence. The new approach – which has been viewed as the early glimmering of the modern welfare state – aroused much controversy. This book presents translations of Domingo de Soto’s intervention in the controversy (In Causa Pauperum Deliberatio), as well as of his treatments of poverty and property in his magisterial De Iustitia et Iure and elsewhere. Accompanying the translations is an extensive introductory essay that analyses the juridical significance of Soto’s reflections on rights, poverty, and property. Among other matters, the introductory essay elucidates Soto’s notion of the right to beg, as well as the different ways to conceptualize the relationship between extreme necessity and private property. Throughout, Soto’s views are presented in the light of other scholastic thinkers from whom he drew, or with whom he disagreed, or who explicated his ideas. The essay also notes connections to the thought of the great Dutch jurist of the next century, Hugo Grotius. Legal theorist and classicist Ernest Weinrib brings together the disciplines to illuminate Soto’s role in the intellectual history of poverty and of its relation to private property.

In Bad Faith is the historical thriller where a subpoena, a newsroom, and a movement collide. In 1970, New York Times national correspondent Earl Caldwell--one of the first Black reporters hired to cover America's civil-rights flashpoints--was ordered to reveal what he had learned about the Black Panther Party behind the sealed doors of a federal grand jury. This book provides the first in-depth study of the crime of bigamy from the 17th century to the present day. Between 1604 and 2024, around 30,000 individuals were prosecuted for bigamy in England and Wales. A few were able to establish a defence to the charge, but most were convicted. How they were punished varied hugely across the centuries - from execution, branding, whipping, transportation, and imprisonment through to fines and community service. Double Trouble details the legal framework that underpinned such prosecutions. As a companion volume to Double Lives: Stories of Bigamy in England and Wales, 1604-2024, it sets the offence in the context of the changing laws on marriage and divorce, and examines the consequences of bigamy for those involved, including the remedies that were available to the often-deceived second spouse. Drawing on a wide array of sources from the 17th century to the present day, including formal law reports, legal treatises, newspapers, censuses, parish registers, divorce petitions and Parliamentary debates, this book shows how bigamy should be taken seriously as an offence that all too often involved deception, abandonment and heartbreak.
