This book develops an understanding of how the public-private distinction operates in judicial review and freedom of information laws in England and India, and examines how the distinction may affect public law accountability for Public-Private Partnerships. Drawing on experiences from England, it examines some of the public law concerns that arise from the participation of the private sector in the provision of public sector services. The comparative approach sheds light not just on the similarities but also on some important differences in the working of the public-private distinction across the two mechanisms of judicial review and freedom of information laws, and across the two jurisdictions. Since differences in drawing those distinctions may lead to different outcomes for the amenability of entities to public law, the research undertaken in this book is helpful not only in expounding, but also predicting the working of the public-private distinction. Scholarship on administrative law from the Global South has hitherto been limited, and this comparative study presents a valuable contribution towards addressing this gap. The book will be of interest to practitioners, academics, researchers and policy-makers working in the areas of Administrative Law and Comparative Law.

This open access book analyses whether and to what extent fiscal transfers from central to local governments affect democracy at sub-national level. Fiscal transfers are often perceived to undermine democracy, as politicians utilise them to build patronage networks, weaken opposition candidates, and reward local governments that support them. On the other hand, others have argued that fiscal transfers serve to improve local governance, increase transparency, reduce corruption, and promote democracy. &nbsp;Drawing on eleven country case studies from Europe, Asia, and Africa, this book examines the extent to which local governments are affected with the risks connected with intergovernmental fiscal transfers. Whilst it has been broadly accepted amongst academics and policymakers that the Eurozone turmoil originated in the banking sector and then deterritorialized towards peripheral Economic and Monetary Union countries, the mechanisms implemented for this transformation remain understudied. Using a non-performative reading of Deleuze and Guattari's concept of the assemblage, the book analyses the mechanisms used in Greece and the Economic and Monetary Union to transfer the financial and moral responsibility of the crisis from the private to the public sector. Combining insights from political economy, economics and social studies of finance, this investigation critiques the austerity policies imposed by European institutions, and identifies the ‘green and just transformation’ as the best way forward to address the ongoing Eurozone problems. This book considers whether Parliament recognises a constitutional right to property. Parliament is supreme: in theory, there is nothing to stop it from passing laws to confiscate property. Nevertheless, MPs often argue that a proposed law would be unconstitutional. What does this mean in a system without a written constitution? What counts as a sound argument about constitutional rights? And what influence do constitutional arguments have on the legislative process? The book takes a close look at these questions. It reviews legislation and debates from the Middle Ages through to more recent legislation, and covers a wide range of topics, such as land reform, nationalisation, taxation, regulatory laws and retrospection.
