Governments around the world are privatizing everything, with dramatic but largely ignored negative consequences for human rights. This open access book outlines the response that is urgently needed. Corporations are being given control over water, healthcare, housing, public transportation, child welfare services, aged care, and much else. Privatization is promoted by international financial institutions, consulting firms, and development actors as the answer to public finances devastated by the very tax cuts insistently pushed by these groups. Their pitch is based upon a mythology that extols the virtues of an idealized market while ignoring the heavy human rights costs incurred. Building on the latest evidence and on specially commissioned case studies, this book shows how the touted 'efficiency' of the private sector is often predicated on higher charges and/or reduced services, destructive employment practices, and the highly predictable exclusion of many users. Privatization generally costs states more money, marginalizes democratic decision-making, and transforms citizens from rights-holders into customers while sidelining accountability. The authors develop an approach designed to enable human rights actors, including courts, UN treaty monitoring bodies, and NGOs to move beyond their longstanding agnosticism towards privatization. It starts with a presumption that privatization is inherently retrogressive in human rights terms. Whatever mix of public and private is reflected in any given arrangement, governments must retain the degree of control necessary to ensure respect for rights, and the legal, financial and administrative ability to do so. The book charts a new direction for responding to the ever-growing threat that privatization poses to human rights. This book examines how the shipping industry is responding to the commercial challenges caused by geopolitical risk. Geopolitical volatility in the modern world is generating physical and economic obstacles that are disrupting shipping activities and causing disputes that raise fundamental questions of commercial law. Studying this phenomenon by exploring common themes among varied dimensions of business disruption, the book first explores physical disruption to shipping activities across the categories of war, unrest, and piracy. It then turns to the purely economic disruption caused by sanctions and alternative forms of statecraft deployed in "trade wars." The book examines each of these categories by highlighting geopolitical and regulatory context, assessing industry adaptations, and analysing cross-jurisdictional case law to gather insight into the contractual rights and responsibilities impacted by these scenarios. The often-forgotten global story of how the Confederacy lost its bid for sovereign nationhood In 1861, proslavery secessionists severed ties with the United States, launched the Confederacy, and readied their new government to join the international community as a sovereign nation. In The First Pariah State, Robert Bonner tells the story of how a transatlantic publicity campaign dashed Confederate hopes by ostracizing its rebellion as an immoral, global menace. The international anti-Confederate campaign built on existing antislavery themes but moved far beyond them. Improvised indictments circulated secessionists’ most incendiary words across the world. The Union and its foreign allies condemned the marauding Southern navy for disrupting high-seas commerce, violating civilized norms, and preparing for the resumption of the African slave trade. Abraham Lincoln and Senator Charles Sumner sought to convert rhetorical barbs and maritime anxieties into novel doctrines of international law designed to counter rogue regimes. And Union opinion-makers, including Black abolitionists, worked with European supporters to stymie the South’s naval expansion, war finances, and diplomatic efforts to gain formal recognition. International worries about the Confederate rebellion waned after U.S. victory, and the Southern pariahdom of the 1860s left few enduring traces in international law or overseas remembrances. In fact, over the next century and a half, the pro-Confederate “Lost Cause” mythology proved to be as powerful abroad as it was within the restored United States.
